Minutes of the AINVSA National Delegation Meet at JNV Khurai, M.P on 7/4/2013

MINUTES OF THE NATIONAL DELEGATION MEET
AT JNV KHURAI, SAGAR DISTRICT, MP 
        ON 07 APRIL2013                                                      
The National delegation meet commenced in the Forenoon of 7th APRIL 2013, with the introduction of all the Office bearers, C.E.C members, Vice Principal of the Jawahar Navodaya Vidyalaya, Khurai, Sagar Dist. MP, etc by Shri Yogendra Sharma, Vice President of AINVSA.

The National President of AINVSA Shri. T.P Mani presided over the function.

Inaugural Speech of Shri T.P.Mani the President of AINVSA
Shri T.P.Mani, in his inaugural speech, expressed pleasure, at the outset, on seeing all the C.E.C members after such a long time. He reflected his views on the Staff meeting with Shri Shashi Tharoor Hon’ble Minister of State, Ministry of HRD during the negotiation table that amidst 21 demands only Pension matter was discussed at length with Shri Shashi Tharoor. The hon’ble minister had given assurance for the preparation of Cabinet note, albeit two Cabinet note were already rejected in the yesteryears during the tenure of Shri. O.N.Singh And Shri Manoj Singh Hon’ble Commissioners of NVS.
Shri T.P.Mani showed the Registration papers to all present there and reminded once again that manipulating the Registration number without the permission of the holder and changing the head office of the Association to some other place such as Warangal instead of the Head office address of Kotyam declared in the Bye Laws in 1994, amounts to Forgery and hence a criminal offence.
He further brought home the point that conducting of strike such as indefinite strike recently was futile. Simple assurance with no concrete steps taken by Govt, of India & NVS to that effect, in the past too, resulted in the calling of the strike in 2009, as well. He directed the representatives of the Negotiation talks with NVS authorities during indefinite strike days,   to shed light on the happenings.

Facts of the Negotiation table- talks.
Mr. P.K Gupta Organising Secretary  and Mr Yogendra Sharma, Vice President of AINVSA then gave the details of the happenings during the table talks with the NVS authorities during the Indefinite strike period. Mr P.K Gupta placed on record that such written assurance for CCS PensionScheme Rule 1972,   10% to non teaching staff and working hours was for the first time in the annals of NVS history.  Mr Yogendra Sharma enlightened the members that the Hou’le Under Secretary of HRD Ministry,  Mrs Vrinda Saroop on 09/02/2013 was in favor of Recognition. That there should be regular meeting with the Staff Association within every two months and that no policy or circular finalized without discussion with the staff Association reflected her espousal to the Recognition of the association. He shocked the members by saying that the grant of 10% special allowance to non teaching staff was in the hands of the Joint Commissioner (Admin) only. If he wishes it could be given, undoubtedly. He added that the NVS authorities has decided to include the award winning teachers and those having a good academic record as members of the so called ‘Committee’ to be formulated  for work hours and the like.

Technicalitites of Registration and Bye Laws:
Mr Mahendra Kumar  Vishwakarma, PGT Hindi  briefed about the technicalities of Registration and he requested the National President of AINVSA to declare about his possession of Registration papers of AINVSA and the Bye laws. That action should be taken against those accumulating money in the name of AINVSA and explanation should be called for. The road map and future plans of AINVSA should be clear.

Condemnation of JNV Sholapur incident in Pune Region, Safety & Security and Unity of staff:
The .C.E.C Members out rightly condemned the untoward happening of the dacoit at JNV Sholapur, Maharashtra state in Pune Region on 03-04-2013.The teachers and Vice Principal of the Vidyalaya were physically assaulted, with serious injuries, and their money and valuables looted in the wee hours.
The safety and security of the staff and family should also be taken care, apart from the students. Police protection should be given to the Navodaya Vidyalayas especially those remote and sensitive ones .
The oration of Mr. M.K.Singh, C.E.C member was a poignant one. He spoke at length on the death incidents and suspension case in Navodaya Vidyalayas and how at times the staff unit was the only succor. He appealed the staff to be united and focus on Unit awareness, plead for compensate appointments to the survivors of the deceased ones in NVS , metaphorically stated to recognize  true AINVSA : to check out whether it is the driver or is it the cleaner who is driving the vehicle on which they are to commute.

Supreme Court case for CCS Pension Scheme rule 1972:
Mr. Krishan Kumar, Vice President of AINVSA  gave his predictability of 99.9 % of NVS employees wining the case for CCS PensionScheme Rule 1972. He threw light on the technical flaws the cutoff date as 31 Dec,1985 for CCS PensionScheme Rule 1972 to autonomous bodies—just a gap of 4 months deprived the same to NVS employees. Never the less the RTI document procured; that NHRC established in 1993 much after the establishment of NVS, is ironical and discriminatory. Simultaneously, he added, the cabinet note assured by Hon’ble  Minister Shri Shashi Tharoor should be expedited, as well. The eligible staff for CCS PensionScheme Rule 1972 in NVS was not more than 8000 employees at any cost, and that Govt. of India shouldn’t  be stringent for that.

Staff Welfare measures by AINVSA :
Dr. Vinay Kumar Singh, Joint Secretary of AINVSA spoke at length on the background of AINVSA; the cause and conflict of AINVSA. He cautioned the members present of the forces and persons involved in manipulative behavior such as distorting R. registration number and even the logo of AINVSA in the past. He expounded the AINVSA efforts in the enhancement of grade pay and 10% special allowance in the 6th Pay Commission: drafting of AINVSA forwarded by the then Commissioner, NVS to the Sixth Pay Commission Committee., and cited such other instances of the efforts of AINVSA and its office bearers for staff welfare.

Recognition of AINVSA , Grievance  Redressal Mechanism  and message of Resignation of National Gen.Secretary AINVSA CEC :
The Gen.Sec of AINVSA Gujarat Unit Sh. S.S.Nair, briefed the members present that Recognition of AINVSA should be given top priority. The present withheld salary of indefinite strike period would not have been the case, if the Association was recognized. He suggested that the Staff grievance should be conveyed in writing by the Unit Secretary through proper channel i.e., hierarchy of AINVSA office bearers.  That should be generalized only if that occurred in more than 10 JNVs. He implored that AINVSA should take up the staff grievances redress effectively, provided they were genuine.
He further conveyed the message of Oral Resignation of  Shri. J.K.Singh,  National Gen.Sec AINVSA CEC to the  Delegation and requested the Chair & the Committee to nominate new  National Gen.Secretary  of AINVSA with immediate effect, who has all the qualities of a true leader: good orator, good drafting and many followers . Mere lip service, or pen service or ground leadership would not count, for that matter.
The Central Executive Committee accepted the Oral Resignation of Shri J.K.Singh conveyed to some of the CEC members telephonically by him. It was decided unanimously by the  Executive body to depute three General Secretaries to this effect, so that work would be done more efficaciously and AINVSA strengthened, as it were.

Dissatisfaction amongst the employees in JNVs
The Venue Vidyalaya Vice Principal expressed gratitude over the presence of the Office bearers of AINVSA in the Vidyalaya. But expressed in chagrin the dissatisfaction in employees due to faction in Associations. She requested the office bearers to resolve the matter , be united, and expedite the staff welfare measures in true letter and spirit.

Resolutions passed in the Meeting:
The National President  AINVSA CEC Shri T.P Mani expressed his desire, in the second session, to hand over the rein to the more vibrant and dynamic persons, due to his chronic ill-health. All present there declined, and vociferously demanded for his existence in the association, though all the works would be taken care of exclusively by the new CEC Office Bearers.
The meeting  selected and re-shuffled the office bearers in commensurate with the past works and loyalty to the association which was unanimously conceded to. The past Central Executive Committee (C.E.C) was dissolved and new members nominated until further orders. Please find enclosed herewith separately the list of New CEC members of AINVSA.
The charter of demands of 50 points was framed, as well, for staff welfare, which is appended separately for your perusal and convenience


Vote of Thanks
Shri P.K Gupta proposed a vote of thanks to the Venue Principal, Vice Principal and the entire staff and management for organizing this meeting. He expressed thanks on behalf of all for the precious time spared, by one and all, to those who attended from far off places in the country and making the National delegation a grand success.
