Sir/ Madam,
It when all
the hopes of pension was shattered by the terrible disaster brought about by
the Ranchi H C case filed by Sri.P N Misra a writ was filed by by Sri. S Kannan
(Principal JNV Canacona, South Goa)& Others v/s Union of India& Others
Writ Petition(Civil)518 of 2012.The affidavit of this case was prepared by the
full support of AINVSA. Our documents were also profusely used in preparing the
affidavit. We could also supply some of the key documents. We have no question
of honesty and reliability of the persons involved in the case. The office
bearers could not be signatories of the case as we feared that it could cause a
bit of confusion by certain unwanted elements whose purpose is not to win
pension for the staff but monetary benefit and credit. Hence we whole heartedly
appeal all staff of JNVS, ROs and HQ to help by liberally contributing towards
just enough expenditures. We shall be highly obliged to every well-wisher who
makes such contributions and convince others about the Writ which will be taken
up the 4th of February 2013.Let us hope the best to secure our
future life.
In this connection I would also
like to clarify a couple of points no matter it raises unnecessary feathers.
But at the outset I would like to emphasize that we are always in favour of
reasonable strikes and court case as NVS has always been keeping an
antagonistic attitude to welfare of NVS staff.
1)
The verdict of the Ranchi case left every one shattered
and hopeless.As responsible service organization we had advised Sri.P N Mishra
to include the documents available with us to save the retirement life of
thousands of staff by getting a winning edge. It was hyped up that Sri.L B
Reddy had authorized Sri.P N Mishra to file the case. It is clear that he had
not looked into the textual aspects of the affidavit.When the controversy
regarding credit and money arose Sri.L B Reddy and P N Misra broke apart. I
would like to assert the point that AINVSA did not authorize Sri.PN Mishra to
file the case either in Ranchi H C or SC. Even after the failure of the case we
had held discussions with Sri.P N Mishra during the summer vacation and advised
him not to go for an appeal but to file a fresh case by including some of our
nominees. We had also pushed forward the demand that the accounts have to be
transparent and unnecessary amounts should not be accumulated. Since AINVSA is
not recognized by the government it has been found that any Dick and Harry can
collect money by deceiving the innocent employees in the name of pension. Our appeal
is that every member of staff has to be cautious about this matter and in case
of any doubt we may be contacted. If Sri.Mishra was earnest in this matter he
should have shared some amount for the case being waged by Sri.Kannan &
others. Now pension has become a lucrative business for some deceivers.

It is quite surprising that Sri.L B Reddy also filed a
case in SC on behalf of AINVSA. (W.P.No.556/2012).An attempt was made to claim
that his case was filed before the WP of Sri.Kannan&others.Now he is also
following Sri.P N Mishra in collecting money. It is true beyond any doubt that
Sri. Sri.L B Reddy could not get a share of the porridge from Sri.P N Mishra
hence he too has started demanding money from the hapless and confused staff.It
is our earnest appeal to all that they have to restrain themselves from
contributing because such unauthorized collection of fund is going to kick up a
lot of controversies and administrative action.

JAC was formed with the singular intention of demanding
GOI Pension. Later 10% SA was also added to it. It is very important for every
member of staff and association office bearers that Sri.L B Reddy was never in
favour of holding strikes by staff. In all the JAC meeting he was the only
person we vehemently opposed strike and filing case in SC. On the other hand
his idea was to hold dharnas and maha meeting and facilitate the flow in and
out of money. We were against such futile business.

It was made clear by Sri.J K Singh and Sri.Arun Gaur
at the CEC meeting held at Radhakrishna
Mandir that Sri.L B Reddy was instrumental in the withdrawal of the indefinite
strike. Sri.V L Balasubramanian also divulged the fact, if not in public but in
privacy. It was also revealed by some HQ staff that when the indefinite strike
was being called off Sri.L B Reddy was hobnobbing with some top officers of
NVS. So we categorically state that the withdrawal of the indefinite strike
was the beigest treachery in the annals
of struggle of NVS staff. We had also
demanded the participants of the meeting which saw the fateful withdrawal of
the indefinite case to release a communique for the benefit of the people. But
still now the people are kept in the dark. Why ?

The Mass CL as a means of strike is not bad. But the
context and timing and the way of decision making and execution are not
appreciable. Since the Pension case is in SC it would have taken a natural
course. Some of the leaders involved in the strike also held such opinion in
the past as the matter is subjudice. There was no state committee
meetings and CEC meetings to decide the matter.As some political parties engage
in some activities the leaders here too fear that they would be forgotten by
the people if they do not come to the circus ring and get engaged in
entertaining the people around. It is also a mean of extorting money from them
in the name of expenditure involved in transport stay and food expenses.

The staff of navodaya have always exhibited some
characteristic gullibility. They get drawn by the fiery words of their leaders
who will immediately withdraw into the chambers of NVS officers for relaxation
and fun. People are highly disoriented. They often fail to recognize honest
attempts. We had send warning signas when Sri.P N Misra was demanding
vakaltnama and affadavits from every individual staff. But despite our warnings
the frustrated people send their valuable money and documents. The HC verdict
should be an eye opener for them. The HC severely criticized the petitioner for
his last moment frustration. We had also warned the petitioner that the new advocate would
ditch him. What was the need of the hour was not vakaatnama but strong points
to for defense. Still people are groping in the dark. Do navodayans understand?
I am not sending a lethal note.
There is no brick batting, no mudslinging, no malign campaign, so
self-lionizing, no character assassination. I have been striving for staff
welfare. It was with that singular intention that we had given flesh and blood
to our service association during a time which could be compared to the
medieval period of NVS.I am pained to see the clowns romping all around. The
spectators getting looted and mesmerized clap their hands without knowing what
is actually happening.
I have put the right things in
the right slots. There responsible people to answer. There should be
intellectual honesty and purposefulness. Brinkmanship and feigning will only be
lapped up for some time.
Before I sum up I would like to
request you all to identify the fraudulent ones in the play.
I also appeal to you look forward
to the case filed by Sri.S Kannan & others. Contribute to the case, support the righteous and avoid the imposters.

Because as i saw that there is no unity among the staffs of navodaya vidyalaya.
