 First Meeting of "All India Jawahar Navodaya Vidyalaya Pension Seekers Forum" held at JNV Tapi( SURAT),Gujarat: a single agenda of OLD PENSION, (GOI 1972: GPF cum Pension Scheme)


 A Navodaya Vidyalaya Pension Seekers’ Forum meeting was held, at JNV Tapi,Vyara on 30 August,2012 in the forenoon . The meeting commenced with welcoming of the guests  and participants by the Venue Principal Sh. K. Sanjay. He introduced the agenda of the meeting; that the meeting was conducted to bring all Service Associations under one umbrella , to strive to get the Old Pension Scheme GOI 1972. That various Organisations established after Navodayas were getting G.P.F cum Pension Scheme, but why not Navodaya?. That every Navodaya Employee should strive  to make the Forum stronger and fight unitedly for the Old Pension instead of the New Pension Scheme.

The other dignatories and office bearers present in the meeting were Sh.S.N.Rane, Principal of JNV Dangh, Sh.M.K.Singh, C.E.C member AINVSA, Sh. Chaware, Vice Principal, JNV Tapi, Sh. S.S.Nair, Gen.Secretary, AINVSA Gujarat Unit, Sh. G.G.Parmar, Ex-Vice President. AINVSA Gujarat Unit and the like. The members of NVSEWA, Catering Association, Staff Nurse Associations, were also present in the meeting. The members from far off  Navodaya Vidyalayas of Porbander, Patan, Beed, Solapur, Gadchroli, Vadodara, Navsari, Dhule, Dang, Kheda, Panchmahal attended the meeting and spoke on the issue.

Orators such as Sh. M.K.Singh ,Sh.S.S.Nair, motivated the staff to attend such meetings in future , as well. The meeting ended with a Vote of Thanks by the Vice Principal of JNV Tapi Sh. Chaware. The meeting was a grand succeess. All  felt the necessity  of filing an SLP by the this forum to get the old pension for the staff.

MINUTES OF THE JOINT ACTION COMMITTEE (JAC)OF ALL THE SERVICE ASSOCIATIONS OF NAVODAYA VIDYALAYA SAMITI HELD ON 19/08/2012(SUNDAY)
The JAC meeting of All Service Associations of Navodaya Vidyalaya Samiti , is convened on 19/08/2012((Sunday) at Radha Krishna mandir, Amar colony, New Delhi, for reviewing and formulating the activities of  JAC.

At the outset Sri J.K.Singh , General Secretary ,AINVSA , welcomed the gathering. He has enumerated the purpose of convening the meeting in a detailed manner. He informed that the meeting was organized in consultation with all the  Member Associations of NVS, for discussing at length the ongoing activities and action plan to be worked out in regard to the burning issues of the employees of the Samiti.
Sri L.B.Reddy,General Secretary, AINVSA,felt that we have to build up pressure on the NVS administration for solving the day to day problems faced by the employees in a sustained manner and to solve the burning problems like CCS pension and 10%special allowance to non-teaching staff in a right spirit. He further stated that unless we are united in our approach to the problems, we are not sure of succeeding in our efforts.
Sri Raj Kumar Radi,General secretary,NVSEWA,also expressed his views for the strengthening of the struggle for achieving the CCS pension and 10%special allowance to non-teaching staff.
Sri V.Bala Subramanian , President of the Principals forum ,expressed his solidarity with other Associations of the Samiti,in the fight for the achievement of legitimate demands of the staff.
Sri. Vijay Kumar,President,Catering assistants and Mess Workers Association has opined that the only way to finding solution to our genuine demands CCS pension 10%special allowance to non-teaching staff is to wage relentless fight with the administration and to put up an united stand.
Sri N.K.Pawa , expressed his solidarity with the fighting staff of Navaodaya Vidyalaya Samiti.

     Competent Authorities and to deliberate on the same.

III. The charter of demands of the staff will be submitted to the NVS in the first week of September 2012.
IV. To prepare the staff of NVS for direct action in the month of October 2012, in the event of non-solution to
       our legitimate demands,The exact date will be intimated in due course  of time.

V. The National Council of JAC will be formed with 40 members, duly providing equal representation of 8     
        members each for the 5 Asscociations@one member from each region representing each Association.

VI. Shri.L.B.Reddy, Shri Raj Kumar Raddi and Shri. J.K.Singh will make all the correspondence jointly.

Sir/Madam,

     As you know very well the President and Secretary of All India Jawahar Navodaya Vidyalaya Principals’ Forum have retired from service of NVS 2 ½ years back.  We had personally requested many Principals to take the charge of the body, yet no one has come forward to take up the responsibility.

     Lot of efforts have been made to get the pre – 2004 GO I pension  to the emplpoyees of NVS.  It is in this context that the JAC meeting of all the associations of JNVs has been proposed.

     We are trying to constantly think why Navodaya Vidyalaya Samiti has not taken stern steps to introduce the GOI pension (Pre- 2004) scheme to the employees in spite of the fact that rules are in favour to us.  There are around 40 positive arguments in favour of us whereas, there is only one point raised by Ministry of Finance that our organization was started (registered) only in 1986 and therefore not entitled for pension scheme.

     Out of many positive arguments the following are worth mentioning.

1.      The memorandum of Association of Navodaya Vidyalaya Samiti under Societies Registration Act XXI of 1860 with the caption Regulations 24 (ii)(i) is read as follows.
“To determine procedures for payment of pension, gratuities or provident  fund of employees of the Society or to their wives, children or other dependents”.
2.      As  per the clause 24 (ii) (i) why is that the procedure for payment of pension was not initiated even after 26 years of the existence of Navodaya VidyalayaSamiti.  The procedure of option for pension should have been circulated by Navodaya Vidyalaya Samiti at least when the direct recruitment was formally begun in 1989 in r/o teachers and in 1986 itself in r/o non-teaching staff.
3.      Who has decided to enforce CPF to the employees of NVS?  If a former Director/Commissioner has done so without ascertaining the opinion of the employees , it is clearly an injustice.
4.      There was a meeting of Navodaya Vidyalaya Samiti executive committee held on 21st June 2000 in which it was decided that separate justification notes for the extension of pensionary benefits  in the New IIMs’ & IITs’ and Navodaya Vidyalaya Samiti be prepared and submitted.
      In this context it should also be remembered that both the organizations Indian
Institute of Management and Indian Institute of Technologies  were granted old pension scheme  (1972 pension scheme) and Navodaya Vidyalaya Samiti did not furnish the required notes to Ministry of HRD, in accordance with the resolution taken b y the Governing body of NVS on 21st June, 2000.  The responsible Officers have again made a serious error which puts the employees of NVS in a highly embarrassing situation.
5.      As per the memorandum of Association of Navodaya Vidyalaya Samiti under Regulations 25 it is clearly mentioned the duty of Director/Commissioner as follows:
“It shall be the duty of the Director to see that all decisions taken by the committee are implemented”. The then Director/Commissioner of Navodaya Vidyalaya Samiti and the administrative section of NVS Head quarter should be made answerable for the dereliction of their duties for not preparing the requisite note for extension of pensionary benefits.

     It is beyond the comprehension of any one why Navodaya Vidyalaya Samiti has not taken up the matter at the appropriate time.
6.      The Registrar of Indian In statute of Technology, Bombay vide their circular dated 3rd April 1999 had extended an opportunity to their employees governed by CPF scheme to switch over to GPF cum- Gratuity scheme if the employees desire so.
                
                It is with shame we have to look up on the Administration of Navodaya Vidyalaya
           Samiti, that they could not extend  the opportunity to their employees as done by IITs’.

               There are many more substantial reasons to put forth the eligibility of the
           employees who have joined prior to 1-1-2004 to get old pension scheme.
7.      As a matter of fact the cutoff date  between the old pension scheme and new pension scheme itself is 31-12-2003.  This is a struggle for existence of the employees of NVS against  irrational treatment In the issue with regard to pensionary benefits.
8.      Thus a final attempt, JAC meeting is scheduled at Radhakrishna Mandir, Lajpath Nagar, New Delhi on 19th August, 2012 at 3p.m.  Those Principals nearby Delhi/Bhopal etc. are requested to attend the meeting and oblige.
                India got freedom from Britishers after centuries of struggle.  Employees of
           Jawahar Navodaya Vidyalayas’ will also get their due share if they are ready for
           another  struggle.


           Some may act till they meet obstacles, others  act  in spite of obstacles  and conquer  them; but some actnot, fearing the possibility of some obstacles,that might arise  enroute.

Representation Proforma for LIBRARIANS

Respected Sir,

            Subject: Library services – stock weed out – losses – penalty collection from                                     Librarian – additional staff requirement – Regarding
            Reference: CBSE library Manual and Government of India financial Rules.


            I would like to bring to your kind notice the following few lines related to Library services and its functioning in JNVs.   It is universally accepted fact that the library plays a pivotal role in any educational institution for the enrichment of teaching learning process for the students and faculty.
            The NVS has been giving lot of importance to the library services and its organization since its inception.  Recently, the library fund is also raised up to one lack per annum.  The librarians are putting all the efforts to justify the services for the students and the staff of the institution. We are comfortable with the available infrastructure and resources.       
    At the same time I would like to bring to your kind notice the following aspects which were not thought of by NVS so far
               The total strength of the vidyalaya students is between 450-520 and the faculty                      is around 30
i)                    Every day the visitors in the library are around 150 to 200 students.  And 10 to15 faculty members. The issues and the returns consumes the whole time of 45 minutes in a period.
ii)                  The total collection goes up to six to eight thousand and the periodicals are around 45.The issues and returns are around between100 to 150 per day.  The single librarian is not able to guide the students individually and not able to take care the theft of books,    since the book stock and the reading place in the single hall, is congested for the free browsing and reading of the books.
The loss of books in is alarming every year. The loss/theft is the common practice by the students, in spite of the vigilance over students .The losses are collected from the librarian from his hard earned money.  Every librarian is penalized thousands of rupees (10000 to 25000) at the time of transfer. .
TheNavodayadayaVidyalayaSamithi has not specified any guidelines regarding the loss of books. Therefore the total loss is being recovered from the Librarian
                                                      
 GOVT OF INDIA FINACIAL RULES FOR LIBRARIANS


Rule.194. Physical verification of Library books:

(i) Complete physical verification of books should be done every year in case of libraries having not more than
Twenty thousand volumes.. In case such verification reveals unusual or unreasonable shortages, complete verification shall be done.
iii)            Loss of five volumes per one thousand volumes of books issued/consulted in a year may be taken as Reasonable provided such losses are not attributable to dishonesty or negligence. However, loss of a bookof a value exceeding Rs. 1,000/- (Rupees One thousand only) and rare books irrespective of value shall Invariably be investigated and appropriate action taken.
The stock verification, weed out l and condemnation is the common practice in any library

iv)                The NavodayaVidyalayaSamithi has formulated the condemnation procedure for all the departmental stores except libraries. So, the un used, mutilated, obsolete books are piled in the library for the last twenty five years .in turn ,creating space problem to add new books every year

v)                  .The Government of India financial rules has mentioned about the condemnation, weed out, damage, mutilated, obsolete material from the accession.

Rule 196. Disposal of Goods.

An item may be declared surplus or obsolete or unserviceable if the same is of no use to the Ministry or Department. The reasons for declaring the item surplus or obsolete or unserviceable should be recorded by the authority competent to purchase the item. The competent authority may, at his discretion, constitute a committee at appropriate level to declare Item as surplus or obsolete or unserviceable.

vi)                 For the extensive use of library resource, the additional staff is essential. An attendant service may be very much useful for the better services in the library.  The CBSE has mentioned the staff formula in its Library manual.  But the NVS has ignored this manual.  The CBSE has also evaluated the entire library services in detail in the manual.
vii)              As per the CBSE Library Manual the Staff formula for Senior Secondary Schools is as follows: 
1.      Librarian PGT (one) 2. Assistant Librarian TGT (one) 3. Library Attendant (one).

Keeping in view of the above facts I honestly request your kind self to look into the matter of losses, weed out of books and sanctioning the attendant post.

Your kind personal attention towards the long pending and genuine issues of library may be resolved. Hoping the positive decisions and necessary steps by reviewing the practical difficulties and the functioning of the JNV libraries.
