Sub: Minutes and Resolutions /Charter of demands of ‘AINVSA GUJARAT Meeting’ held at JNV PATAN on 28 March,2010

Sir,
A Meeting of All India Navodaya Vidyalaya Staff Association(AINVSA) Gujarat was held on 28.03.2010 at JNV Patan,Gujarat. 30-40 Members from different parts of the State participated in the meeting. The meeting started at 11.00 AM with the lighting of the lamps and offering of Bouquets to the dignitaries present such as the Principal and Vice Principal JNV Patan,(Venue), Vice Principal JNV Sabarkantha, Office Bearers of AINVSA CEC and Gujarat SEC such as Mr.M.K.Singh(JNV Kheda),Mr.S.S.Nair(JNV Surat/Tapi),Mr.Vijay Dave(JNV Porbander) etc.

At the outset,the Vice Principal of the host Vidyalaya Sh. N.S.Lengure, welcomed the gathering .He emphasized that two agendas (i)Pension GOI -1972 and (ii)10% special allowance to the non teaching staff should be given priority and the rest would follow.He stressed on the relevance of such meeting and appreciated the members to have come from far off distance reflecting their tempo and spirit.The Vice Principal of JNV Sabarkantha Sh.Shekh set the ball rolling for discussions of the agenda., with his experiences of JAC Meeting at Pune and revolutionary oration to knock the doors of Courts if need be, to achieve the Old Pension GOI-1972.He very systematically adduced the reasons why the employees joined after 2004 should assist this venture too. ..as in future it could be extended to them if at all it commenced now.

Shri M.K.Singh Treasurer of AINVSA(CEC) took up the baton further by his spurring elocution of the unity of all associations for the fulfillment of Old Pension GOI-1972 demands. The JAC is doing the task effectively under the altruistic leadership of Sh. V.L.Balasubramanian; Navodaya staff should trust the JAC members.He spoke at length how rumours are spread to split up the unity of all associations and people should not rely on such hearsay things.He explained the reasons why the two members were expelled and warned the members of Gujarat not to support them by forwarding any sms received by these two expelled members Sh. Yogendra Sharma and Sh.Gajendra Yadav. Moreover he implored that people in navodaya should have unity.They should not put anyone’s job at stake by giving false evidences due to vested interest or personal vengeances against each other.Mr Singh was followed by Mr.Jignesh Bhatt: JAC Member and Ex–Gen Sec AINVSA Gujarat.

Mr Jignesh Bhatt, Pune –JAC Member very analytically gave a report of the Pre-Post Strike situation in Gujarat.He gave the review of the Pune-JAC Meeting and the nuisance created by the expelled members Sh. Yogendra Sharma and Sh.Gajendra Yadav there.He suggested that Gujarat should take the initiative in developing their own fixed time table.This was followed by the briefings of Mr Sajith.Nair, Gen.Secretary AINVSA Gujarat unit of the Stepping-up and bunching of pay of Seniors to justify their pay with that of juniors. He pointed out how AINVSA Gujarat had taken the initiative in drawing attention of the Samiti to the anomalies and had sent a simplified write-up of the CCS(RP) Rules,2008 to all 08 Regional Offices and AINVSA CEC with a request to forward the matter, that entry-pay scale should be given to the newly entrants and stepping-up & bunching should be done to the seniors . Bunching should be done as per Clause A(ii) directed in Note 2A, below rule 7 .The calculation should be done as per Illustration 4A in CCS(RP) rules,2008. He requested the members present that they should raise this point whenever any higher NVS Officials visit their Vidyalayas. Mr Vijay Dave, the President of AINVSA Gujarat, in his elocution stressed upon the dire necessity of Warden post in Navodaya Vidyalayas.The teachers could pay more attention to their professional development if such posts are created.T his would save their time and they could teach more effectively the rural talented children of this country. He also emphasized that work hours should be fixed in Navodaya Vidyalayas.

Many other members also opined and shared their concern about the step motherly treatment of the Government in granting Old Pension to NVS employees. Indefinite Strike and Court cases were the only options available. Mr R.P Jadhav implored that the Bye-laws of the association should be made stronger, there should be monetary avenues for the association and that the Association should be recognized at the earliest. AINVSA should fight for its own RECOGNITION first. Similarly some rules should be chalked to inspire those who have joined in between 2004 and 2009, to make them join this struggle for Old Pension.Mr J.D.Painter of JNV Dahod also added that 40% staff at Vidyalaya level are not involved in such moments, and the Association should ponder over that.The Association should challenge the ‘Transfer Policy’ of NVS. Sometimes Samiti transfers an employee on Admn ground without any cause just to adjust another employee, of which he himself is a victim. In such cases the transferred employee becomes the juniormost in this new vidyalaya.The association should raise this question: Whether the seniority is lost to the employee transferred on administrative ground by NVS ,wthout any fault or any wish of the employee. Mr Jayesh Desai(Joint Secretary,AINVSA Gujarat) of JNV Banaskantha stressed on the importance of defined work hours in Navodaya Vidyalayas. That the root cause of 80% grievances in any Navodaya Vidyalaya was the erratic work schedule.We do not find any similarity in the work schedule timings in any of the Navodaya Vidyalayas in Gujarat forget about those in the country. Thus a comparison starts in, and the employees of the Vidyalaya where there is a tight schedule/ more work hours are in a fighting mood with the Principals with no fault of his. It was important and in the interest of both the Prinicpals and the staff to have a common timetable in Navodaya Vidyalayas throughout the country. He further cited examples of other orgainisations and institutions wherein OTA(overtime allowances), compensatory leave etc were provided in lieu of the extra work they put in .Even in police deptt which calls for twenty four hours duty, there is a rotational rest of every 04 hours in between. Its totally funny that we are rejected Old Pension on the ground that we are getting Special allowance of 10%,(say Rs2000/- or so) , as Old Pension is also provided to those institutions wherein the employees are getting more that Rs2000/- as incentives and perks.

The Principal of JNV Patan, Sh. D.Rajeswar Rao spoke at length on the importance of Recognitions of the Associations, that there should be one association wherein all Peons to Principals are members and they should have a Member ID, and then only we should proceed to such activities as Indefinite Strike, Dharna etc.The JAC State meeting should be called and there should be mandatory participation of two members from each Vidyalayas. The presence of the staff could be in some fixed percentage/ ratio of TGTs,PGTs Prinicpals etc. The staff should be increased by NVS to decrease the work load. More recruitments should be done for some of the posts. However, appointing Wardens would sometimes enchance nuisance in administration. He suggested the members present that clear cut resolutions should be formed in meetings such as whether joined after 2004 should be involved or not, what about probationers? Should they be left out etc. and communicated effectively to all Vidyalayas. Feed back should be obtained from all schools regarding the same and then forwarded to the JAC Central level. The meeting was successful , and it ended with a Vote of thanks by Sh.Dinesh Tripathi of JNV Patan.

AINVSA Gujarat puts on record the dedication of Mr.Navneet Chauhan (Convenor and Patan unit Secretary) for organizing and excellently anchoring the programme throughout ,as well as the staff of JNV Patan for taking up the task at this need of the hour. Praises to JNV Gandhinagar and JNV Banaskantha for sending maximum participants from the Unit. Seven members or so ,who have joined NVS after 2004, attended the meeting from JNV Banaskantha showing the spirit that the newcomers are also supportive in the Struggle for Pension GOI-1972.

The resolutions and Charter of demands forwarded by AINVSA GUJARAT to AINVSA CEC and JAC-Central level are as under:

(i)Recognition of Association is a must to legalise our fight for Old Pension and 10% Special allowance to the non-teaching staff.
(ii)The fight for Pension GOI and 10% SA to Non teaching staff should go on. Indefinite Strike and Court case - the only options available.
(iii)Pension GOI-1972 should also be extendable to those who have joined between 2004 and 2009.
(iv)Members would not help anyone in spreading rumours disrupting the unity of Associations. Separate meetings are conducted only to strengthen the pillars of JAC.
(v)AINVSA Gujarat disagrees to some of the points of Rough Draft of Transfer Policy framed recently. The employee should not lose his seniority if he is transferred on Administrative Ground without any cause.
(vi)There should be a “Common Time-table” for all Vidyalayas in NVS. The afternoon or evening timings should also be the same in all Vidyalayas throughout the country.Work hours should be defined and a written direction to this effect should be given by NVS Hqrs,New Delhi.
(vii).There should be Warden post in Navodaya Vidyalayas.For every 100 or 200 students a Warden should be recruited to decrease the work load of teachers and utilize their resources more effectively to the benefit of the students
(viii)Stepping up of pay and bunching both essential to do justice to the Seniors’ pay fixation.
(ix)Members should depend on emails, and make their own email- ids and unit email- ids for speedy and non-financial communications. Communication--a must to strengthen the Association.

PUNE MEETING

Minutes of the First State Level Convention of Employees of Jawahar Navodaya Vidyalaya’s of Maharashtra, Goa, and Daman Diu and Navodaya Vidyalaya Samiti, Regional Office, Pune.

In pursuance of the decisions taken at the 2nd JAC (Joint Action Committee) of Navodaya Vidyalaya Samiti Employees, on 01.10.2009 at PHD Chamber of Commerce and Industries, Chandigarh, a State Level Convention of Employees of Jawahar Navodaya Vidyalaya’s of Maharashtra, Goa, and Daman Diu and Navodaya Vidyalaya Samiti, Regional Office, Pune has been held on 2nd November, 2009 from 10.30 am to 3 pm at Shishak Bhavan, Pune. The Convention was coordinated by Mr. R.T. Lad, Principal, J.N.V Kolhapur and Mr. Maindarge, Principal, J.N.V Pune under the inspiration of Shri. R.S. Nayak, Principal, J.N.V South Goa, who is also the Secretary of National Level JAC.

A total of 56 employees representing all categories of employees from Jawahar Navodaya Vidyalaya’s of Maharashtra, Goa, and Daman, Diu and Navodaya Vidyalaya Samiti, Regional Office, Pune including Principals and Section Officers attended the convention and very sincerely and constructively joined the deliberations and decision making process. The presence and involvement of Mr. Shri. A.S. Sawant, the Principal, J.N.V Raigad, Mr. N.R.Naidu and Mr. K. Subhash Section Officers from Regional Office Pune, indeed provided an extra ounce of reassurance and an added sense of unity to all those gathered at the convention.

The following the agenda points were discussed streamlining the convention.

1.To strengthen the National Level J.A.C, by constituting State Level and Regional Level J.A.C.’s.
2.Appraisal of the preparations made by the JAC (National Level) for the rally on 9th Novemeber, 2009 at New Delhi.
3.to make public declaration of the token strike scheduled for 16th November, 2009.
4.To ensure effective and maximum participation at the Mass Rally in New Delhi, on 9th November, from each units/JNV of Pune Region.
5.To inaugurate “Black Badge Days” as circulated in the 2nd JAC meeting minutes, by formally serving and wearing black badges during the convention.
6.To discuss action plans to be followed at Unit Levels for formation of Unit Level JAC. ( i.e. at JNV level ).
Every communications made during this State Level Convention has been very much a sort of cordial interactive programme rather than mere individual speeches. The deliberations were solely concentrating on the issue of Government’s reluctance to grant G.O.I Pension 1972 to the employees of N.V.S. During such deliberations the following decisions have been formed during the State Level Convention.

It has been unanimously agreed that all the employees of N.V.S Pune Region irrespective of their category and designation should come under one banner i.e, of Joint Action Committee of .NVS Employees, to fight for the legitimate ‘RIGHT’ of pension. Every participants at the convention is expected to convey this very important message at their respective units and offices.

The convention appreciated the activities and decisions so far taken by the National Level JAC, and decided to render unwavering support to them.

The convention assessed the outcome of peaceful methods adopted by the employees of the Samiti for getting G.O.I Pension. It has been observed that a lot of crystal clear representations quoting supportive rules and clauses as well as proof of discrimination, to the H.R.D Ministry, observing Hunger Work Day on Teachers’ Day, meeting with H.R.D Minister ..etc, have not prompted the government to call us for any negotiations. We are not even answered “what makes us ineligible for pension? and 10% Special Allowance to Non-teaching staff of JNVs”. Hence, it is decided that an overwhelming support to the Mass Rally on 9th Nov. in New Delhi and an unwavering solidarity to the token strike scheduled on 16th Nov. must be ensured from JAC Pune Region.

The “Black Badge Days” for the employees of NVS Pune Region has been inaugurated. Every participants in the convention wore the badges in protest against Government’s deaf ear towards us. It has been decided that in every units and at R.O Pune, every employees will be issued with the badges and will wear the same till Nov. 7th, 2009 not only in the office premises but also at wherever they move.

Each units under the inspiration of the Principals will ensure maximum participation at the Mass Rally in New Delhi.They ought to prepare and carry a banner on white cloth/flex in the size of 6’x3’. The following matter should be got printed on the banner. – “MASS RALLY OF EMPLOYEES OF NAVODAYA VIDYALAYA SAMITI FOR GRANT OF THEIR RIGHT TO GET G.O.I. PENSION 1972” Besides, as many number of posters and placards as possible, with slogans demanding pension and 10% Special allowance to the non – teaching staff should also be carried. Examples of slogans “OUR DEMAND –

PENSION AT PAR WITH OTHER CENTRAL GOVT. EMPLOYEES” ; “WHY DISCRIMINATION TO US?”

Further it is decided that if the govt. fails to make favourable considerations in the matter of pension and allowance, without any second thought each units under Pune Region will go for a day’s Token Strike in full swing, closing even the Mess. The food for the students may be managed by making it a Parent’s visiting day and asking them to bring food for their wards and Migrated students and thus making them too aware of our plight.

While discussing the formation of State Level and Regional Level J.A.C., it has been learned that to get recognition and legal support from the respective department, for any union or committee, following aspects are to be ensured.
1.Minimum 50% of the total strength of the employees needs to be registered members of the union.
2.Personal consent of the employee needs to be obtained by way of filling up the membership form.
3.Each members of the union should be issued with an identity card.
4. Monthly contribution as decided in the bylaw must be paid regularly by the members.
5.Besides, for the ‘Muscle Power’ the union could seek affiliation from any other registered trade unions of India.

In this context, Mr. R.T. Lad, the Principal, J.N.V Kolhapur and Mr. Maindarge, the Principal, J.N.V Pune, have voluntarily agreed to take up this task for Pune Region.

It is decided that each units will form a unit level JAC comprising representatives from all category of employees, before the end of November2009. Later these unit level office bearers will be assembling at Regional/State Level to elect actual office bearers for the State Level / Regional Level JAC’s.

Unit Level JAC will collect a regular monthly fees of Rs. 20/- (Rupees twenty only) from every member and maintain a fund.

Further, it is unanimously agreed to form two ADHOC JAC COMMITTEES – one at Regional Level and the other at State Level to execute the immediate requirements.

The Conveners of this state level convention, Shri. R.T Lad and Shri. B.A Maindarge, besides co-ordinating the convention, assured their continuous and active involvement in strengthening and guiding the State and Regional Level JAC Committees. The other speakers included, Shri. R.S Nayak, the Principal, JNV South Goa who in the capacity of Secretary JAC, Employees of Navodaya Vidyalaya Samiti, reminded the members to stay united and keep up the spirit of the convention in all future occasions. Besides, Shri. N.R Naidu and Shri. K. Subash Section Officers from NVS, R.O Pune, exhorted for unity of all employees for the cause of pension.

Mr. Tonde, PGT Hindi, JNV Amaravati, recounted his experience during a golden chance, he got for meeting with Mr. Rahul Gandhi, Hon. M.P. at his residence in New Delhi. Followed by the meeting of employees at JNV Amaravati on 2nd February, 2009, and utilizing the influential links there, a delegation of 11 members, including, Mr. Thonde met Mr. Rahul Gandhi, on 25th Feb, 2009. It is reported that Shri Gandhi said that their meeting referred to his long cherished desire to meet the employees of NVS. He has been waiting for a chance. Mr. Tonde, expressed his confidence in assurances given to the delegation by Mr. Rahul Gandhi. At the same time he fully agreed that the planned rally and if required the strike will be instrumental for easy fulfillment of those assurances’. The delegation could also meet the Honourable Her Excellency the President of India, on 20th Feb, 2009 and conveyed the grievances.

Mr. Tonde was appreciated for all his selfless efforts and wonderful gains and was requested to utilize all the possible influential corners for the success of the missions of JAC.

Formation of Regional Level Joint Action Committee

Held on 30th August 2009 at Jawahar Navodaya Vidyalaya Rajkot (Gujarat)

With a view to come under a single roof and work united for the betterment of the employees, a joint meeting of all the associations/ forums of Jawahar Navodaya Vidyalayas and Navodaya Vidyalaya Samiti was held on 9th August 2009 at New Delhi. Consequently a joint action committee was constituted to get our just and genuine demands materialized. The demand of 1972 CCS Pension scheme ( GPF cum Pension Scheme ) 1972 has been taken up for the present.
In this connection, a Joint Action Committee of Pune Region was organized on 30th Autust 2009 at JNV Taragadhi (Rajkot ) in Gujarat State.
The programme started with the lighting of lamp and offering of bouquets to the office bearers and members. The host Principal Shri T. M. Nair welcomed the gathering. It was followed by orations of Mr. M. K. Singh (AINVSA), and Mr. Y.P.Vyas (NVSEWA). Mr. M. K. Singh gave brief report on the current happenings of JAC- Central Level. Mr. Y. P. Vyas emphasized on the future course of action to be taken at JAC- Pune Regional level.. Mr. R. Anchuri , conducted the proceedings.
The second session commenced with ‘action plans’ prepared by each association. The GPF cum Pension scheme (1972) was highlighted. The Office Bears of different associations focused on the implementation of Old Pension Scheme ( GOI- 1972) in NVS, especially to those joined prior to 01.01.2004. Special allowance of 10% to Non-Teaching Staff was emphasized, as well.
Mr. Sajith. S. Nair, Gen. Secy. Of AINVSA (Gujarat Unit) explained the general guidelines for observing the teacher’s day as “Hunger work day “ on 5th September 2009. Mr. A. K. Prasad called upon the unity of all associations to achieve the demands successfully. Mr. K. M. Dhankecha (LDC), and Mr. Buwade (Librarian) also expressed their views. The other speakers who spoke on the occasion were Mr. Vijay Dave (Music Teacher)JNV Porbandar, Mr. Kanjiya,( TGT Hindi) JNV Panchmahal, Mr. R. D. Bamaniya ( O.S.) JNV Diu, Mrs. Anita Mokhade( PGT Biology)JNV Rajkot, Mr. R. A. Chavda (TGT) Gujarati) JNV Rajkot Mr. Manohar (TGT S.St.) JNV Ratnagiri, etc..

Minutes of the meeting of REGIONAL LEVEL JOINT ACTION COMMITTEE

The members of JAC – Pune Region formed on 30th August 2009, in compliance with the decision of JAC – Central Level, decided as under:

1 A team of Vidyalaya employees to meet the Hon’ble M.P. of their Parliament constituency on or before 05th Septembar 2009 with a well prepared representation.
2. It has been decided to observe 5th September 2009(Teachers Day) as “Hunger Work Day” to draw the attention of authorities of Govt. of India for the dare need to implement GPF Cum Pension Scheme to those employees of NVS who have joined prior to 01-01-2004
3. All the teaching& non teaching staff including Principals will work on 5th September 2009 with at most dedication but Fasting the whole Day.
4. Since 5th September 2009 is Saturday and not a working day for regional offices of NVS and Head quarters, they will be attending the near by JNVs and ensure participation of Hunger Work Day.
5. The Gandhian method of fasting and working has been unanimously decided by JAC – Central Level taking into account the tolerance we have exhibited during the last two decades on the Pension issue, the commitment to the students and the society in the ongoing process of Nation building.
6. The members of JAC- Pune Region and other members who attended the meeting will take the responsibility to disseminate this message to all Jawahar Navodaya Vidyalayas across the Pune Region .
7. State wise/Unit wise the member should take the responsibility to mobilize all the employees, in order to make fasting on 5th September a Grand Success.
8. Wide publicity should be given to the same through news papers, TV,Radio and other mass media by the units as well the JAC – Pune Region Members.
9. The matter should also be brought to the notice of the respective Member of Parliaments (M.P.s), all the Ministers of the Central Government by individual JNVs and JAC – Pune Region members.
10. JAC – Pune Region will Meet again after successful observance of Hunger Work Day to review the same and to decide the further course of action

MINUTES OF JOINT ACTION COMMITTEE MEETING

Held on 09th August 2009 at New Delhi

Initiative was taken by AIJNVPF/AINVSA/NVEWA to call for a joint meeting on 9th August 2009 at Radhakrishna Mandir, Amar Colony, Lajpat Nagar, New Delhi at 10.30 am to discuss about formation of a joint Action committee of all the associations and to prepare an action plan for the future on a one point agenda of getting GPF Cum Pension scheme (CCS Pension 1972).

The first session of the meeting was presided over by Sri T P Mani President of AINVSA and Sri J K Singh Gen. Secretary AINVSA welcomed the gathering.

The second session was chaired by President Principal’s Forum.
Representatives spoke on the urgent need to unite together for the welfare of the employees of Navodaya Vidyalaya Samiti and representatives from each association including Sri T P Mani, Sri V L Balasubramanian, Sri J K Singh, Shri, Sivanarayan, and Sri.L.B.Reddy spoke on the occasion. It is a matter of great happiness that all the representatives unanimously decided to come together under one umbrella taking up issues one by one so that all the employees stand together to achieve genuine and just demands of all the members of Navodaya Vidyalaya Samiti.

The second session of meeting unanimously decided to form a joint action committee to take further course of action. Members were drawn from all the association and the Navodaya Vidyalaya Employees Joint Action Committee (NVEJAC) was constituted. The list of JAC is enclosed as annexure 2.

Minutes of the meeting of NVEJAC
The members of JAC met on 9th August 2009 by evening and decided as under
1. A team of JAC headed by Sri V L Balasubramanian to meet the Hon’ble Minister of HRD Sri Kapil Sibalji on 10th August 2009 with a well prepared representation.

Meeting with the Minister of HRD Sri Kapil Sibalji on 10th August 2009 at 19 Theen Murthimarg,New Delhi

A delegation consisting of 11 members of JAC called on the Hon’ble Minister Sri Kapil Sibalji,MHRD on 10th evening at 7.30 PM.The team appraised the minister on the long pending issue of introduction of GPF cum Pension Scheme to the employees of NVS who have joined prior to 01-01-2004.

Sri Kapil Sibalji has assured to examine the case and the rational behind the issue.On the basis of rationality of the case a decision will be taken soon.The delegation thanked the Minister and placed the representation for further examination by the Ministry.
