PENSION GOI 1972 DEMAND – CONVENTION AT PUNE

Dear Friends,

A convention is to be organized in Pune, Maharashtra  on 15^th February 2015  in order to evolve a solution for the Pension Case, dismissed by Hon. Supreme Court recently, filed by Staff of Different JNV’s. 

All who are interested to join are whole heartedly welcomed.

All the Unit Associations are requested to send representatives in more numbers so as to demonstrate the unity of Associations, before the NVS Administration and UOI (Union of India) to achieve the legitimate and genuine age old demand: CCS PENSION, GOI 1972 Scheme to the employees of NVS.

At least Four Delegates (Two teaching & two Non-teaching) from each Vidyalaya should participate in this convention along with the Principal/ Vice Principal in order to represent properly , and come to an unanimous opinion.

Dear Friends,

You all may be aware of the verdict of Honorable Supreme Court regarding the pension case filed by Staff of Different JNV’s.  The case was dismissed leaving all JNV Staff in to sec helplessness.  The dejection thereby caused a lot of agony and frustration among all the staff who work hard sincerely round clock to manifest vision and mission of nation and Samiti into reality.  The unfold and numerous  sufferings of the staff, particularly earlier staff, who without base essential means toiled to  establish is spotted  globally and  appraised  as one of the  best educational institutions in the world.  But the most painful part is that govt.  forget the blood sweating of the  staff and  our basic right of pension (CCS 1972) has been flatly rejected. It is our right and we have to get it.  Till we get it we have to fight for it.

In order to evolve a solution for this convention is organized in Pune on 15^th February 2015.  All who are interested to join are whole heartedly welcomed.  The venue is

The National Convention for Pension CCS 1972 Policy i ro NVS employees finalised to be held on 15 Feb 2015 itself

The National Convention for  Old Pension  Scheme is utlimately finalised on 15 Feb 2015. Of course Review Petition would materialise. But what other steps and measures to be done in the achievement of our Herculean task would be discussed on this day  at Pune, Maharashtra.

All office bearers  of different Associations, RO Pune officials , Retired employees of JNVs , RO s and Hqrs as well as some dignitaries and guests who could shed light on this issue  would all be present there..

As everybody is aware the Hon. Supreme Court had dismissed our writ petition basically citing the Ranchi High Court decision in the matter of Sh. Mishra Vrs NVS and Others. As everybody is already aware while approaching the Hon. Supremet Court we had very earnestly requested Sh. Mishra and others  not to move Supreme Court with SLP because his case was very weak and not supported with any proper documents before the Ranchi High Court. Whereas  in our writ petition we had filed a detailed case in support of our case for CCS Pension 1972. It is now humbly requested everyone that please pursue Ranchi people and Mishra not to move with a review petition before Hon. Supreme Court as it will  jeopardize our genuine case in writ petition 518 of 2012 before the Hon. Supreme Court as it is directly affecting around 15000 employees and their families. Conduct Rules Ammendment for Ladies staff

Subject: Central Civil Services (Conduct) Rules 1964 — Guidelines regarding prevention of sexual harassment of women at the workplace - regarding

Following the promulgation of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [SHWW(PPR) Act] and notification of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Rules, 2013 [SHWW(PPR) Rules] on 09.12.2013., the Government has recently, on 19.11.2014, notified the amendments to Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965. 

The amendments and other salient features of the Act/ Rules was brought to the notice of all concerned vide Office Memorandum of even no. dated 27.11.2014. The amendments to the Central Civil Services (Conduct) Rules 1964 and Classification, Control and Appeal Rules, 1965 and the Office Memorandum dated 01.12.2014 are available on the Department’s website.

2. The following guidelines, conveying the decision of the Committee of Secretaries on this subject, were issued vide this Department’s Office Memorandum No. 11013/3/2009-Estt.(A) dated 03.08.2009, “As regards provisions for protection of women, it was suggested that the complaints committee mechanism provided under Vishakha guidelines relating to sexual harassment should be strictly in accordance with the judgment and steps should be taken to ensure that the committee is effective and functional at all times. It would also be desirable for the Committees to meet once a quarter, even if there is no live case, and review preparedness to fulfil all requirements of the Vishakha judgment in the Department/Ministry/ organization concerned.”

3. As per the guidelines issued vide Office Memorandum dated 21.07.2009, it is also to be ensured that the Complaints Committee shall at all times be in existence and changes in its composition, whenever necessary, should be made promptly and adequately publicized. The composition of the Complaints Committee should also be posted on the websites of the concerned Ministries/Departments/Offices concerned.

4. Vide the Office Memorandum dated 01.12.2014, the attention of the Ministries/Departments was also invited to the reporting requirements mentioned in the SHWW(PPR) Act and SHWW(PPR) Rules.

5. All Ministries/ Departments are requested to please review the progress of implementation of the existing abovementioned guidelines issued in the aftermath of the Vishakha judgment.

6. Attention of all Ministries is invited to Section 22 of the Act relating to including information in Annual Report, and to request that information relating to number of cases filed, if any, and their disposal may be included in the Annual Report of the Ministry / Department.

7. All Ministries / Departments are also requested to furnish an annual return (as on 31 stMarch) in the enclosed proforma to this Department by 30th April every year.

NATIONAL CONVENTION for PENSION GOI 1972 deferred to 22 FEB,2015

The Proposed National Convention for Pension GOI 1972 is hereby postponed  to 22 Feb 2015 to be organised at Pune... initiated by Retd Prinicpal JNV Canacona Sh. R.S.Nayak.
