Sub:- Proposed JAC meeting to be held on
19th August, 2012.
Sir/Madam,
As you know very well the President and
Secretary of All India Jawahar Navodaya Vidyalaya Principals’ Forum have
retired from service of NVS 2 ½ years back.
We had personally requested many Principals to take the charge of the
body, yet no one has come forward to take up the responsibility.
Lot of efforts have been made to get the
pre – 2004 GO I pension to the
emplpoyees of NVS. It is in this context
that the JAC meeting of all the associations of JNVs has been proposed.
We are trying to constantly think why
Navodaya Vidyalaya Samiti has not taken stern steps to introduce the GOI
pension (Pre- 2004) scheme to the employees in spite of the fact that rules are
in favour to us. There are around 40
positive arguments in favour of us whereas, there is only one point raised by
Ministry of Finance that our organization was started (registered) only in 1986
and therefore not entitled for pension scheme.
Out of many positive arguments the
following are worth mentioning.
1.
The memorandum of Association of Navodaya Vidyalaya Samiti under
Societies Registration Act XXI of 1860 with the caption Regulations 24 (ii)(i)
is read as follows.
“To
determine procedures for payment of pension, gratuities or provident fund of employees of the Society or to their
wives, children or other dependents”.

As per the clause 24 (ii) (i) why
is that the procedure for payment of pension was not initiated even after 26
years of the existence of Navodaya VidyalayaSamiti. The procedure of option for pension should
have been circulated by Navodaya Vidyalaya Samiti at least when the direct
recruitment was formally begun in 1989 in r/o teachers and in 1986 itself in
r/o non-teaching staff.

Who has decided to enforce CPF to the employees of NVS? If a former Director/Commissioner has done so
without ascertaining the opinion of the employees , it is clearly an injustice.

There was a meeting of Navodaya Vidyalaya Samiti executive committee
held on 21st June 2000 in which it was decided that separate justification
notes for the extension of pensionary benefits
in the New IIMs’ & IITs’ and Navodaya Vidyalaya Samiti be prepared
and submitted.
In this context it should also be
remembered that both the organizations Indian
Institute
of Management and Indian Institute of Technologies were granted old pension scheme (1972 pension scheme) and Navodaya Vidyalaya
Samiti did not furnish the required notes to Ministry of HRD, in accordance
with the resolution taken b y the Governing body of NVS on 21st
June, 2000. The responsible Officers
have again made a serious error which puts the employees of NVS in a highly
embarrassing situation.

As per the memorandum of Association of Navodaya Vidyalaya Samiti under
Regulations 25 it is clearly mentioned the duty of Director/Commissioner as
follows:
“It
shall be the duty of the Director to see that all decisions taken by the
committee are implemented”. The then Director/Commissioner of Navodaya
Vidyalaya Samiti and the administrative section of NVS Head quarter should be
made answerable for the dereliction of their duties for not preparing the
requisite note for extension of pensionary benefits.
It is beyond the comprehension of any one
why Navodaya Vidyalaya Samiti has not taken up the matter at the appropriate time.

The Registrar of Indian In statute of Technology, Bombay vide their
circular dated 3rd April 1999 had extended an opportunity to their
employees governed by CPF scheme to switch over to GPF cum- Gratuity scheme if
the employees desire so.
It is with shame we have to
look up on the Administration of Navodaya Vidyalaya
Samiti, that they could not
extend the opportunity to their
employees as done by IITs’.
There are many more substantial
reasons to put forth the eligibility of the
employees who have joined prior to
1-1-2004 to get old pension scheme.

As a matter of fact the cutoff date
between the old pension scheme and new pension scheme itself is
31-12-2003. This is a struggle for
existence of the employees of NVS against
irrational treatment In the issue with regard to pensionary benefits.

Thus a final attempt, JAC meeting is scheduled at Radhakrishna Mandir,
Lajpath Nagar, New Delhi on 19th August, 2012 at 3p.m. Those Principals nearby Delhi/Bhopal etc. are
requested to attend the meeting and oblige.
India got freedom from
Britishers after centuries of struggle.
Employees of
Jawahar Navodaya Vidyalayas’ will
also get their due share if they are ready for
another struggle.
Some may act till they meet
obstacles, others act in spite of obstacles and conquer them; but some actnot, fearing the possibility
of some obstacles,that might arise enroute.
