Minutes of the CEC Meeting Held on 11-05-2010

The meeting of Central Executive Committee, AINVSA, was held on 11th May 2010 at Nigam Model School, Janakpuri, New Delhi. It was presided over by Shri Jagdish Rai, President, AINVSA. The following issues on the agenda were discussed:
1. General Secretary’s Report
2. Strengthening of the association
3. Constitution of Joint Action Committee and its activities
4. Constitution of State Units
5. Preparation for 5th National Conference
6. Reports of State Committees
7. Discussions with the Hon’ble Commissioner and other officials

Addressing the delegates of the Association, Shri Jagdish Rai elaborated on the steps being taken to strengthen the Association. He emphasized on the need to work selflessly to carry out the struggle for solution of the problems faced by the staff. Shri L.B.Reddy, General Secretary, briefed the members of the activities undertaken since the formation of the Joint Action Committee. He shed light on the role played by the Association in successfully implementing the decision of the JAC. He thanked all the members of Vidyalaya and State Units across the country that had gone all out in making the Hunger Work Day, Mass Dharna at Delhi and Token Strike a huge success. He brought to the attention of the CEC the various representations submitted to the NVS authorities from time to time for necessary action.

Meeting with the Hon’ble Commissioner
A delegation comprising L.B.Reddy, S.S.Dora, R.K.Dash, Sanjeev Kumar, Sanjay Sinha, N.K.Pargania, H.H.Rai met the Hon’ble Commissioner, Shri Manjoj Singh under the Chairmanship of Shri Jagdish Rai on 10-05-2010 and discussed the issues related to
1. Treating the strike period (16-11-2009) as on duty or eligible leave
2. Exemption of license fee to non-teaching staff
3. Supply of uniform and textbooks to the students
4. Payment of minimum wages to daily waged workers
5. Enhancement of HM/AHM allowance
6. Granting of bunching benefit to the teachers
7. Stepping-up of seniors’ scale with the juniors
8. Violation of recruitment rules
9. Granting of grade pay of Rs.4200 to Computer Operators
10. Promotion of Regional Language teachers
11. Enhancement of retirement age
12. Weekly-off to drivers, staff nurses and electrician-cum-plumber
13. Restoration Earned Leave to teachers in addition to Half-Pay leave
14. Timely promotions to all the categories of staff
15. Appointment of wardens and matrons to strengthen the NVS scheme
16. Provision of hostel subsidy to staff wards
17. Delegation of Administrative transfer powers to Regional Offices
18. Application of MACPS (Modified Assured Career Progression Scheme) to teachers
19. Relaxation of service of PGTs to the post of Principals on the lines of KVS
20. Filling-up of posts of Office Superintendents
21. Relaxation of 3-year mandatory period for Request/Mutual Transfers
22. Constitution of JCM/Anomalies’ Committee with the Representative of Teaching Community
23. Relaxation of 10-year Mandatory period for teachers working in Hard Stations

Resolutions:
1. All State Committee will collect 2% per cent of the gross salary of the Members and deposit it in any nationalized bank by opening a Savings Bank account in the name of General Secretary and Treasurer.
2. All states to identify a minimum of ten to twenty members who can undertake the Association activities with dedication, discipline and commitment.
3. State Committees will organize State Level Conference/Convention before 31st December 2010.
4. The 5th National Convention will be organized in April 2011.
5. The CEC also took a unanimous resolution on the demands put forward to the Hon’ble Commissioner, Hon’ble Minister for HRD and Hon’ble Prime Minister.

Sub: Nominating a teachers’ representative in JCM & Anomalies Committee to voice their concern – Request – Reg.

Respected Sir
In connection with the subject cited above, we may humbly be permitted to draw your attention to the necessity of nominating a Teachers’ Representative to represent the concerns and opinions of thousands of teachers working in Central Government’s reputed educational institutions like the Navodaya Vidyalaya Samiti, Kendriya Vidyalaya Sangathan, Railways, etc.

The AINVSA regrets to note that the teaching community working in Central Government has not been given its due recognition and it also not found a suitable platform to voice its concerns for the last five decades. It is time that the government of India gives the teaching community its due recognition in the backdrop of revolutionizing the country’s educational scenario by enacting the Right to Education law.

In the absence of a teachers’ representatives in Joint Consultative Machinery (JCM) and Anomalies Committee, etc. many of teachers’ problems in connection with working hours in residential institutions, earned leaves, promotions and several other service related issues found no appropriate platform, and, as a result, the teachers feel sidelined and ignored.

Sir, it is time to undo the injustice meted out to the teaching community working in Central Government schools by giving due weightage to their representation by making suitable amendments in the body of JCM and Anomalies Committee, etc.

Sub: Expression of gratitude at the revised rates of HM/AHM allowance and few other financial proposals.
Respected Sir,
The AINVSA is pleased to express its happiness at the approval by the Finance Committee to a few of our long-pending demands like enhancement of Housemaster allowance, mess charges, payment of minimum charges fixed by the Labour department for the daily wage workers, etc.
The Association has been demanding for the increase of Housemaster/Associate Housemaster allowance from Rs. 300&150 to 5000&4000 respectively for many years as existing rates are far from encouraging the teachers from discharging their duties wholeheartedly. Though the enhancement of Rs 800&400 is not up to our expectations, we are happy to note NVS has finally shown some positive consideration for the burden shouldered by the Housemasters/Associate House masters.
However, the Association regrets to note that its age-old demand for the exemption of license fee in respect of non-teaching staff has been deferred. We request the Samiti to take up the issue in all sincerity and do the needful.
The AINVSA expresses its happiness at the revised rates of HM allowance, we request the Samiti to seriously pay serious consideration to periodical enhancement of the same as the success of the Navodaya vidyalayas rests on sound House management system.

Respected Sir

Kindly refer to our representations submitted to the Ministry of HRD regarding implementation of GPF Cum Pension Scheme to the employees of Navodaya Vidyalaya Samiti,.The Joint Action Committee of various Associations/Forum had called on you on 10th August 2009 .Please recall the assurance your good self had given to us that the matter would be examined in detail with reference to the rationale behind the non introduction of GPF Cum Pension Scheme to the employees of NVS in spite of the fact that the Navodaya Vidyalaya Samti was established during 1985-86.The matter was also referred by many Members of Parliament. Yet no decision has been communicated.

I. The following facts justify our genuine demand for implementation of GPF Cum Pension Scheme.
1. While CPF Scheme was introduced in 1991, the employees of Navodaya Vidyalaya Samiti were not consulted and CPF was thrusted on the employees.
2. When the 4th Pay Commission Report which was accepted by the Govt of India had recommended to give an option to the employees to switch over from CPF to GPF scheme,the opportunity was not bestowed on employees of Navodaya Vidyalaya Samiti
3. During 1995 when Chief Vigilance Officer of Ministry of HRD requested Navodaya Vidyalaya Samiti to implement 1972 CCS Pension rules to the employees, the then officers ignored the direction(Refer:- D.O No C 33011/10/81-Vig dated 17-07-1995,31st August 1995,and even number dated 10th October 1995)
4. When employees of Similar Organizations like Kendriya Vidyalayas,Sainik Schools, Central Tibetan Schools are granted GPF Cum Pension Scheme to the employees who have joined prior to 01-01-2004, our legitimate right of social security of similar Pension Scheme has been denied .
5. Various Parliamentary Committees set up for examining the functioning of Navodaya Vidyalayas like 154th ,178th,198th have strongly recommended to introduce GPF Cum Pension Scheme to employees of NVS.
6. .The Parliamentary Committee Report on Navodaya Vidyalaya by Sri Y N Chathurvedi vehemently criticized the discriminative approach of the Govt by not giving Pension while the same was granted to the similar organizations under the same department.
7. Many institutions under MHRD viz ,IITs,IIMs,National Institute of Open Schools, Institutions under UGC,CBSE,NCERT etc have been granted with GPF Cum Pension Scheme.
8. In the recent order of Ministry of HRD vide letter NoF 4-26/97-UJ (A) dated 10th July 2009 issued by Director (HE) has granted GPF Cum Pension Scheme to the employees of 5 Inter-University Councils including National Assessment and Accreditation Council.
9. Employees of Navodaya Vidyalaya Samiti who have been representing on the issue for the last 2 decades are frustrated. The peaceful method of observing hunger work day on 5th September 2009 by the employees didn’t bring any change in the attitude of the administration or the Government. The teaching and non teaching staff of 576 Jawahar Navodaya Vidyalayas across the country have been working almost for 18 hours a day without availing Sundays& holidays especially taking care of safety & security and education of students belonging to rural areas in the residential setup.

II. 10% SPECIAL ALLOWANCE TO THE NON-TEACHING STAFF
Consequent upon the recommendations of VI CPC, the teaching staff of Navodaya Vidyalayas have been sanctioned Special Allowance @ 10% of Basic Pay. However, the same has been denied to the non-teaching staff despite our oft-repeated demands. Time and again we brought to the notice of the concerned officers the special working conditions prevailing in the JNVs as a result of the unique residential nature of the vidyalayas and the need for identification of the workload thrust upon the non-teaching staff.

The non-teaching staff is also a part of our Residential System and they equally deserve the allowance granted to teaching staff. Along with the teaching staff, the non-teaching staff also stays on the same campus and discharges their duties right from 5:00 in the morning till 10:30 at night. They too work on all seven days of the week like the teaching staff. The duties of non-teaching are equally essential for the successful running of the Vidyalaya. The services of the teaching and non-teaching, thus, go hand in hand. Depriving the non-teaching staff of the special allowance is unjust. Even the VI CPC has rightly recognized the role played by all the staff in the residential system, not making any difference between the teaching and non-teaching staff.

In the light of the above, we humbly request you to review the decision taken earlier which has ignored the interests of the non-teaching staff and belittled their contribution, and initiate a suitable action in the direction of sanctioning Special Allowance to Non-teaching staff at the earliest.


The Joint Action Committee held at Chandigarh on 01-10-2009 has decided the following activities:-
1. To observe 2nd November to 7th November as Black badge Days to express our resentments by all the employees of 576 JNVs Regional Offices and Head Quarters office of NVS.
2. A mass rally will be held at Jantar Mantar ,New Delhi on 09-11-2009
3. A Token Strike will be observed on 16-11-2009 in all the 576 Vidyalayas, Regional Offices and Head Quarters office of NVS by all the employees including Officers & Principals.

Kindly consider this as a notice given by Joint Action Committee of Employees of Jawahar Navodaya Vidyalayas &Navodaya Vidyalaya Samiti

We earnestly hope that the Government and Navodaya Vidyalaya Samiti will not drag us to a strike situation which we never prefer to and settle our Issues by giving top priority.

You are kindly aware of that the JAC of staff associations of NVS has given notice for observing a token strike on 16-11-2009 at all the JNVs, Regional Offices and head quarters of NVS and observing week long black days from 2-11-2009 to 07-11-2009, besides staging a rally at Jantar Mantar, New Delhi on 09-11-2009.

At the back drop of the above notice the NVS administration through JC (Admn) has issued the above referred letter to all THE Deputy commissioners of all the regions, enumerating there in, their so called efforts for the introduction of New Pension Scheme for the all the employees of NVS and advised us not to resort to protest/ strike scheduled next month. They have further recorded in the said letter an element of threat to the all the employees of NVS, that if any employee tries to disrupt the working of JNVs , ROs and Head quarters disciplinary action has to be initiated against them as per rules.

In the same connection we exhort the necessity for united action with doubled vigour and enthusiasm to make the scheduled programme for which the JAC has given a call, a grand and resounding success, duly sending an appropriate signal to the Navodaya Vidyalaya Samiti and Govt of India that we are irrevocable and un-compromisable in the matter of GPF cum Pension Scheme and 10% special allowance to non-teaching staff of Navodaya vidyalaya Samiti.

We need not give any importance to the above referred letters of the NVS. We may recall that the NVS had issued such threatening letters during our National Dharna on 27-02-2008 and 29-12-2008 and we had disregarded the same and exhibited our unflinching resolve to achieve our legitimate and genuine demands.

It is therefore appealed that we shall be more united and face challenges for the successful organization of the protests, Dharna, Rally and token strike and be prepared even for more sacrifices in the days to come, in order to achieve our genuine demands.

Sub:-Organisation of Rally from Ramlila Maidin to Jantar Mantar on 9-11-2009 Regarding

You are all kindly aware of that the Joint Action Committee has given a call to organize Mass Rally at New Delhi on 9-11-2009, in order to press our most legitimate and genuine demands of grant of CCS pension 1972 and 10% special allowance to the non teaching staff.
In the same connection it is brought to the knowledge of all the participants of the proposed rally that :-
1.The Rally will commence at 9.00A.M from Ramlila Maidan New Delhi, reach Jantar Mantar about 12.00 Noon and culminate into public meeting. As the distance involved is about 5kms, all the participants are requested to keep their personal luggage at the place of lodging/railway station/Bus station (cloak rooms) etc.

Hence all the participants are requested to reach Ramlila Maidan by 9.00A.M on 9-11-2009 in large numbers and make the mass rally a grand success

2. It is informed to all the participants of the proposed Rally that some accommodation is provided by AINVSACEC Warangal at Garwal Bhavan, Jhande Wallan, Near Karol bagh, New Delhi for one day on 9-11-2009.

3.It is very heartening to know that the CAT Hyderabad Bench, where an OA Petition was filled by the staff of NVS Hyderabad region, has directed the government of India to review and consider the grant of CCS pension1972 to us on 3-11-2009. It is therefore pertinent to all of us to plunge into action with doubled vigor. By the same order the CAT has ordered for keeping in abeyance the New Pension Scheme orders of NVS for a period of three months from the date of the orders (03-11-09 to 03-02-2010)

Responding to the call of the Joint Action Committee the teaching and non teaching staff of Jawahar Navodaya Vidyalayas will protest wearing black badges from 2-11-2009 to 7-11-2009 in support of their demands for 1.granting of CCS pension, 2 .10% special allowance to non teaching staff and resolving of their long pending problems. It is to be mentioned that various departments (KVS,Tibetan schools) functioning under Govt. of India are enjoying the CCS pension. The NVS staff have been unjustifiably deprived and denied of the benefits of CCS pension despite the fact that the organization came into existence in 1985. The outstanding discipline and commitment shown by the teaching community has set very high standards in the field of secondary education and elevated the status of NVS. The staff of NVS has appealed to the government of India from time to time from several platforms for CCS Pension but the plea has fallen on deaf ears.

In case of non grant of above demands the staff of JNVs may proceed on indefinite strike in all the vidyalayas.

Now the staff has decided to intensify their struggle against the injustice by waging democratic protests by:-

1. Wearing of black badges from 02.11.2009 to 07.11.2009. All the members are observing protests by wearing black badges through the country.
2. Organizing National Rally on 09.11.09 at New Delhi. Five thousand members from across the country are expected to participate in the Rally.
3. Strike on 16.11.2009 at 580 vidyalayas across the Country and its administrative offices.
Shri.JagdishRai,Shri.L.B.Reddy,President& General Secretary respectively of All India Navodaya Vidyalaya Staff Association (AINVSA) has informed to the press in a press communiqué. The office bearers of AINVSA have deplored the callous and indefferent attitude of the Navodaya Vidyalaya Samiti and govt.of India. Various political leaders are expected to address the rally.

Dear Friends
Sub:-AINVSA CEC salutes those who made strike grand success.regarding.

The AINVSA congratulates all the State Executive Committees, Central Executive Committee members and Vidyalaya Units for their exemplary efforts in making the one day strike on 16.11.2009 demanding sanctioning of CCS Pension 1972 and 10% special allowance to non-teaching staff a resounding success Kashmir to Kanya Kumari and Kutch to Agarthala have shown their solidarity and staged an unreserved protest against the anti welfare stand of the government of India. This event really would go down in the annals of our fight against injustice.

The one day strike literally brought the work in NVS to a halt as all teaching and non-teaching staff joined hands to wage an unprecedented war against over two decade long injustice and discrimination meted to them by denying the benefits of the CCS Pension 1972 and consequently the social security after retirement. The strike was total. At many Vidyalayas and Regional offices striking staff was visited by the Hon`ble MPs, MLAs MLCs and teacher Associations etc, who had extended their support and sympathy for the demands of the staff.

The AINVSA profusely thanks the JAC and other sister organizations which have whole heartedly extended their co-operation and joined hands in launching the historic struggle.

But we believe the struggle has only begun. In the days to come we have to show more resolution and tenacity. Let us fight unflinchingly against any disciplinary action going to be taken by the management, let us not loose hearts and get ready to intensify our struggle.

At this juncture the AINVSA cautions the staff against any hasty and any ill planned actions. Any unplanned action may dent our struggle and cause an irreparable damage to the movement. The JAC is totally united for the cause and take an appropriate decision at an appropriate time. The ANIVSA will never shirk its responsibility and pledges support and solidarity to the united fight.

We congratulate all the staff once again on their active participation in the strike and hopes that the same vigor and tempo is maintained till the realization of our long pending demands.

Dear Friends,

Sub: Chalo New Delhi to make mass rally a grand success on 09-11-2009 - Reg

In connection with the proposed rally at New Delhi on 09-11-2009 we would like to provide the following guidelines for suitable and necessary adherence at unit level.

1. A minimum of 5 employees from each Vidyalaya must be sponsored. The Vidyalayas close to New Delhi may sponsor more participants depending on the convenience. The Unit Vidyalaya may raise suitable funds and sponsor the staff to meet the expenditure on journey, boarding and lodging.
2. We have booked accommodation for one day on 09-11-2009 at New Delhi. The Participants from far of places may use the accommodation available at GARHWAL BHAVAN, JANDEVALAN, NEAR KAROL BAG, NEW DELHI.
All the participants are requested to ensure that a suitable banner depicting our demands is fastened to the trained/buss/van/carriage so as to provide publicity as follows:











3. All the unit Vidyalayas may arrange a farewell function and suitably felicitate the participants before they leave for the mass rally. Wherever possible the staff should go to nearest railway station, bus stations and extend farewell to the participants duly chanting slogans.
4. As the winter season has set in, the participants may carry suitable warm clothing and take all precautionary measures for upkeep of individual health

Any other suggestion for the successful organization of proposed rally is invited from the units. Let us make a strong resolve to achieve our genuine demands by putting up united struggles in the days to come.

Responding to the call of the Joint Action Committee the teaching and non teaching staff of Jawahar Navodaya Vidyalayas will protest wearing black badges from 2-11-2009 to 7-11-2009 in support of their demands for 1.granting of CCS pension, 2 .10% special allowance to non teaching staff and resolving of their long pending problems. It is to be mentioned that various departments (KVS,Tibetan schools) functioning under Govt. of India are enjoying the CCS pension. The NVS staff have been unjustifiably deprived and denied of the benefits of CCS pension despite the fact that the organization came into existence in 1985. The outstanding discipline and commitment shown by the teaching community has set very high standards in the field of secondary education and elevated the status of NVS. The staff of NVS has appealed to the government of India from time to time from several platforms for CCS Pension but the plea has fallen on deaf ears.

In case of non grant of above demands the staff of JNVs may proceed on indefinite strike in all the vidyalayas.

Now the staff has decided to intensify their struggle against the injustice by waging democratic protests by:-

1. Wearing of black badges from 02.11.2009 to 07.11.2009. All the members are observing protests by wearing black badges through the country.
2. Organizing National Rally on 09.11.09 at New Delhi. Five thousand members from across the country are expected to participate in the Rally.
3. Strike on 16.11.2009 at 580 vidyalayas across the Country and its administrative offices.

A NEWS UPDATE ON Pension AND 10% SPECIAL ALLOWANCE

Dear Officers, Principals and Teaching, Non-Teaching Staff.

May God bless you with what you desire in life. We feel more than happy to apprise you of the latest development in Association, Concerning Pension GOI and 10% Special Allowance to Teaching and Non- Teaching Staff respectively.
Pension GOI and 10% Special allowance is, for the present, high on our agenda.
Latest development at a glance:-

Meeting with NVS Management:- Friends, our joy knew no bounds when we received a telephonic call from NVS Headquarter at 3.30 PM on Nov. 2009, in connection with Indefinite strike call, given by JAC. It was a proud moment for us as we were feeling a bit depressed as Samiti and Ministry were not calling us for talks despite having organized 9th Nov. MAHA RALLY at JANTAR MANTAR and One Day Token Strike on Nov. 16.

First Round of Talks with Sh. Alok Verma:- The opeing round got underway with JC Admin, Sh. Alok Verma’s request to withdraw Indefinite Strike, in the better interest of system. But we firmly and straight forwardly said.
“Sorry Sir, It is our genuine demand that concerns our Post – retirement Life. Pension has been unjustly denied to us. We won’t budge an inch from our stand. It is not in our power. We shall convey your message to all JAC Members and Staff Members in the JAC Meeting scheduled for Nov. 29, 2009 at Maharasthara Bhawan, New Delhi. Final decision will be taken by JAC and Staff.”
At this, he tried to mount pressure on us by threatining with HARSH ACTIONS against us.
Second Round of Talks:- With Hon’able Joint Secretary HRD Ministry Sh. Amit Khere, IAS, at Shastri Bhawan, New – Delhi. We would like to place appreciation for Mr. Khere for his very sympathetic and positive attitude towards our matters. He gave a patient hearing to us and told “Your a demand is just and genuine, Even HRD Minister has okayed the proposal, but problem is from Finance Ministry Side. Finance Minister is not feeling convinced about the matter. This is the problem. I will talk to Finance Secretary in this regard.”
10% special allowance to Non – Teaching Staff:- In this regard he told us that the matter is under active consideration with ministry, and very soon it will be granted. On this we made request – “Sir, please, give this 10% special allowance to all categories of Non-Teaching Staff. In a residential Set up all are equal. Please, do not exclude any single one.”
A Request To RO, Deputy Commissioners:- Friends, we have made a request to all esteemed RO, DCs not to deduct one day (Nov 16, 2009, token strike) Salary, as the act is bound to dampen the spirits of our staff. Now it is up to them what they do.
An appeal to all Principals:- On behalf of AINVSA, JAC and total Staff, through this letter, we make a sincere request to all Principals to support this move. The fight is being fought under the leadership of Principal form. They are all the Front leader of this fight. Now ball is in their court.” We shall be grateful to them for the whole life, if they Join hands with us in this Fight of noble cause.”
Bunching, up gradation stepping up, Bonus and HM allowance:- When we broached these matters to Hon’able JS, Sh. Amit Khere, he assured us to see to these matters. For this, he is going to call Sh. Alok Verma and Sh. M.S.Khanna to the ministry on Nov, 27.
Friends, next JAC Meeting is scheduled for Nov 29, 2009 at Maharashatra Bhawan New Delhi. It is requested to send one or two staff from each school the meeting.

Dear Staff (Teaching – Non Teaching) Principals and officers,

AINVSA JOINT ACTION Committee extends its hearty New Year and X-Mas best wishes to all of you. Amidst no sign of major breakthrough with regard to Pension GOI and 10% Special Allowance, we want to make it clear that out come of 9th November, JANTAR MANTAR MAHARAILY well fell short of expectations. That ‘below par performance’ can be attributed to a host of factors. But for the present, we are not out to take resort to earbashing. Putting every thing aside, at this Juncture, we are fully focused upon our three major targets i.e Pension G.O.I, 10% special allowance and appointment of hostel warden. Friends, a big consipiracy is being hatched by NVS Management through some of its puppet members in JAC to block the way of achieving these targets. On account of ulterior motives and vested interests, SAMITI is keeping us in dark on these matters. Government is extending pensionary benefits to other institutions in quick succession. Have you ever thought why, only NVS Staff is being deprived of these benefits. Know about the inside story.

• As per Indian Constitution, any bill assumes the shape of rule only after it has been tabled on the floor of Parliament and gets seconded by 2/3 majority. If it gets rejected twice, Govt. has a right to table it for the third time. Even if for the third time, It gets rejected it automatically becomes null and void. ‘The New Pension Bill’ has been rejected twice in the Parliament and Govt. could not muster up courage to table it again in the face of Stiff opposition by its own coalition partners as the matter concerned lacs of employees. Now question is why Govt. imposed new pension scheme on us without seeking our concurrence. Just think over it.
• Friends, on June 6th 2006, a meeting of Association of representatives was called by the then commissioner Sh. O.N.Singh, at N.C.E.R.T premises, New Delhi. We were taken aback to see that NAWSEWA and Principals form delegates were already present there. Only six members of AINVSA were called to the meeting. Sad to say, staunch supporter of pension GOI, Mr. O.N.Singh did a U turn on the matter and proposed for the new pension scheme. Our hopes were dashed when the members of Principals form and NAWSEWA accepted the new pension by raising their hand. They told, “ Yes, we accept new pension scheme” Friends, in the presence of all top NVS Officials and members of Associations. I opposed the proposal and made a hue and cry over the matter. There took place an exchange of hot words between me and those so called association delegates. Friends, just after few months of the meeting, the new pension scheme was introduced. It has come to our knowledge through some reliable sources that those so called delegates of association, now members of JAC have put signature on the new pension scheme. We are in the know of those names. If you want to know ring up us. One of those members is operating behind the curtain and expecting to become an Assistant Commissioner. Now it remains to be ascertained whether they signed the proposal of their own volition or under duress.
• Friends, most of NVS officials with fewer exceptions, are on deputation who later on got merged in the system. They are deriving pension from their respective parent departments. Now the matter is in their hands. I make it clear for sure that the matter was never represented to the Ministry in a befitting manner. It is case of misrepresentation, pure and simple. These authorities are least bothered about the matter as they intend to reap the benefits of CPF. After 29th November JAC Meeting in New Delhi, we got in touch with the leaders of ruling dispensation as well as opposition to convey our concerns. They sympathetically listened to us. Now the ministry has sought calculation of expenditure of pension for employees up to 2004. But thanks to samiti’s laid back attitude the calculation is not being forwarded despite the facts that it is already available in the form of “Bhudev Chaterjee Actuary Report.”



• Friends, another most significant reason behind non grant of pension GOI is that during the tenure of one ex General Secretary of AINVSA, we have been branded left supported Association. As the communists have ideological differences with ruling congress. Many MPs have endorsed this fact during our meeting with them. Now, let us make this our task to prove that we are supporters of Late. Sh. Rajeev Gandhi, so that congress Govt. may feel inclined to review the matter.
• Friends, despite our request, some of JAC members on purpose met leaders of opposition. It is good thing but ruling congress may take it otherwise. The biggest example – Six month long Dharna, by Ex Army persons for One Rank - One Pension, at Jantar Mantar. Their demand has been categorically rejected by the Govt. as opposition leader L.K. Adwani announced to induct their demand in his party manifesto. So, it will be wise on our part only to catch Congress MPs rather than opposition or communists.
• Friends, after one day token strike on Nov, 16 Govt. and Samiti were in a mood to consider the matter due to JAC’s call for indefinite strike. Even Intelligence Bureau had sent a very positive report about the success of the strike to the ministry. I have seen that IB note. But unfortunately, some of JAC Members managed to get the 1st Dec. indefinite strike call postponed sine die assigning some lame excuses at the behest of Samiti. Otherwise first Dec. was ripe and most appropriate time for Indefinite strike call.
• Through this letter we request the staff to understand the situation and also officers not to take umbrage at this letter, as the pension is the matter which concerns all. Whosoever works towards it, God will bless him. Friends we have a long fight ahead. Our fight does not ends with these demands. We are yet to press for, hostel warden, pension for staff up to 2009, bunching, stepping up, upgradation, bonus, stress and tension free atmosphere, annihilation of exploitation, objectification of staff, abuse of autonomy and flagrant violation of human rights. The big question is how to survive in the system. Again through this letter we request the concerned NVS authorities, with folded hands, to pave the way. We do not want to be on collision path with Samiti or Govt. We prefer a dovish approach to strike or other destabilizing agitations in the better interest of systems.
• For National Awards, Samiti used to invite 16 TGTs and 16 PGTs throughout the country but this time this number has been reduced. The number is disproportionate to the rising number of staff and JNVs. This is clearly an anti-staff welfare step.

We want to bring to your kind notice that Navodaya Vidyalaya are going totally un-heeded-for, in terms of some genuine and fair demands. NVS staff is rendering yeoman’s Service to make the dreams of visionary statesman late. Sh. Rajeev Gandhi comes true. New Pension Plan has been imposed on NVS employee through a cabinet note without seeking concurrence of employees.
Pension has been denied to NVS employees despite strong and favorable recommendations by Y.N.Chaturvedi Report, Parliament standing Committee, Bhudev Chattergy Actuary Report, HRD minister and NVS Commissioner.
We sincerely request your kind self to peruse the Matter with the Govt. and impress upon Finance Minister Sh. P. Mukherji, So that justice is done to NVS employees. We place immense hope on your sympathetic gestures
We want to draw your kind attention to the fact that the NVS 10 year bond hard station employees working in the North-East Region and in the state of Jammu and Kashmir need to be given relaxation of at least 05 years considering their family and adverse climatic conditions on humanitarian as well as moral grounds. You are requested to impress upon the HRD Minister to take note of the demand.
Ours is a residential setup, staff is working day and night in poor service conditions. No staff welfare measures have been undertaken so far. Non-Teaching Staff indispensable for residential set up have been deprived of 10% special allowance.
Mess in Navodaya Vidyalaya like residential setup is indispensable. Catering Assistant are playing a pivotal role in the system. Their grade pay and service conditions need to be improved .Along with Catering Assistants mess regular and causal workers are working in a pitiable conditions .CAs need to be promoted to the post of general Manger Catering.

Note:- An Association delegation has already met you on Feb 25,2009 at 10 Janpath, but the concern stands hitherto un responded. We are dyed-in –the wool supporters of Late Shri Rajiv Gandhi .Our Association used to be communist controlled but presently it is free from left’s influence .we have taken over as new leaders of association after giving a crushing defeat to left supported elements in Andhra Bhawan New Delhi.

Dear friends (Teaching – Non Teaching)
On account of non performance and breach of trust on the part of Management controlled JAC Members i.e. T.P.Mani, L.B.Reddy, N.K.Pawaha, Shivnarayan Sharma, Raj Kumar Raddi, Bal subranniyam (retired) and Mr. Nayak (On extension), a new dedicated honest team of workers has swung into action. Only Hon’able Commissioner Sh. M.Singh and Joint Commissioner Admin Alok Verma are positive about our issues. The above JAC group is being masterminded by Mrs. N.K.Pawa in particular and by a certain group of officers in general.




Meeting with Rahul Gandhi A delegation led by Sh. Gajendera Yadav, General Secretary, AINVSA met Sh. Rahul Gandhi, at his 10, Janpath New Dehli residence on 9th April, 2010 at 09:30 AM in connection with the demands contained in the memorandum. Mr. Rahul Gandhi gave us a cordial welcome and a hopeful smile. He said “Yes I know Pension Comparison Case between KVS and NVS. I have also talked to Sh. Kapil Sibble over phone in the matter. Don’t float the matter in Media”. About other three issues he directed us to submit a memorandum to Sh. Kapil Sibble with copy to him. The meeting remained very positive and fruitful. He looked fully convinced about our concerns. The delegation members, Gajendra Yadav (HR), Y.K.Sharma (HR), Tarachand Saini (HR), P.K.Singh (Rewari), Rajbir Singh (Tehri Gadwal), Brij Bhushan (Lakhimpur, Asam), Rajendra Kumar (Moregaon, Asam), Vivek Mohan (Delhi), K.M.Sharma (Panipat), Ram Singh (Panipat), Sudheer (Saharanpur, U.P.).

Meeting with Commissioner The same day after meeting with Sh. Rahul Gandhi we called on M.Singh, our newly joined commissioner, we gave him a full briefing of our Rahul Meeting. He felt fully convinced and assured all possible steps in this regard. Pension and 10% matter are under active consideration. The 10 year hard bond matter found favour with him. He directed Mr. Alok Verma to look into the matter and do the needful. In this matter, Mr. Rahul Gandhi also directed us to submit representation to Mr. Kapil Sibble with a copy to him.
Friends, we could no stomach injustice, treachery and breach of trust by JAC. So, we have decided to float a new association. We have applied for National Level registration. New Commissioner also seems in a mood to recognize our association. We need your support and good wises. We shall protect your faith in association. It is our promises. There is still a little glimmer of lope. If you continue to supports us, we shall get all issues settled in due course.

Respected sir,
With due respect we want to draw your kind attention to the fact that the N.V.S. employees working in the 10 Year Bond in the North East and Jammu & Kashmir region considered as hard stations need to be given relaxation of at least 05 years considering their family problems and adverse climatic conditions on humanitarian as well as on moral grounds. For the same issue our delegation have already discussed with Shri Rahul Gandhiji ,honourable member of parliament (General Secretary All India Congress Committee) and he had assured us to consider the matter , positively . You are humbly requested to consider our problems to provide relaxation to the employees.
We want to bring the matter to your kind notice that the concerned employees got recruited under special recruitment drive 2006 in the Shillong and Chandigarh region .Although the concerned employees have already completed 3 years of the service in the region as per the mandatory rule of the Central govt. In the year May 2009 and now requesting for the transfer outside the region due to the following problems/reasons :
1. They are facing a lot of health problems due to longer stay and climatic differences , mental stress and inadequate medical facilities..
2. As per the constitution nobody is bound to serve as the bonded labour which is faced by us.
3. As they are far away from their old and sick parents ,unable to take the due care of them.
4. Due to the regionalism they are unable to give their best for the organisation.
5. There is much difference between the food habits and availability of food items at this part of the country in comparison to other parts of the country.
6. They are facing a lot of depression and tension due to the discrimination between 10 year bond and general employees, it humiliates them.
7. Transportation and education facilities of the staff wards are also the main concern of the employees.
8. As per the Central Govt. Service rules nobody is bound to serve more than 3 years at the hard station which is being followed by our department already. So ,why we are being forced to stay here for 10 years.
So, you are requested to pay the proper attention to their problems and allow them to take the transfer outside of the respective regions .We shall be grateful for your kind compliance.

Sub: Non introduction of GPF-CUM Pension Scheme to the employees of Navodaya Vidyalaya Samiti , Non implementation of 10% Special allowance to Non- Teaching Staff and other very genuine demands -Notice to observe
Indefinite strike from 1st Sept 2010- intimation –regarding.

Ref: 1. Many earlier representations submitted to your office during the last 6 years and rejection of the same by MHRD on the pretext that Finance Ministry does not approve the same.
2. Assurance given by the Secretary(SE&L) of MHRD vide letter No:17-1/2010 –UTIII dt 29-01 2010 and consequent Withdrawal of proposed indefinite strike by the Joint Action Committee which was to be held on 1st Feb 2010.

Sir, The Joint Action Committee of employees of Jawahar Navodaya vidyalayas and Navodaya Vidyalaya Samiti had submitted numerous representations and approached personally your good self and Finance Minister to implement the following long pending demands of employees of Navodaya Vidyalaya Samiti

1) Implementation of 1972 CCS Pension to the employees who joined the service of NVS prior to 1-1-2004
2) To provide 10% Special allowance to Non-Teaching Staff as has been granted to
Teaching Staff of JNVs

In this connection this is also to bring to your kind information that the JAC had fully co-operated with the Ministry and had called off the indefinite strike w.e.f 1st February2010 on the strength of the written assurance given by the Secretary (SE&L) of MHRD on 29th January 2010 vide the letter referred above. In the minutes of the meeting of JAC and Secretary, it has been clearly stated in emphatic terms that the Ministry has been in full support of the demands of the employees of NVS.
But it is a paradox that your ministry has not implemented the demands of the employees of NVS which was started in 1985, where as the benefit of GPF-CUM Pension has been implemented to 5 Inter –University Councils including National Accreditation Council which was started in 1994.
In a democratic country there is no justification to adopt a differential treatment to two departments of the same Ministry with regard to the service conditions of employees. It is beyond the comprehension of any one as to why there is a discriminatory approach of the Govt. to the employees of NVS in comparison to NACC, KVS, CTS, NAOS etc. The 154th, 178th &194th parliamentary committee reports strongly recommended the Govt. of India to re-examine the same mentioning the discriminatory approach, and to extend the 1972 GOI pensionary benefit to NVS. Yet the Ministry has not implemented the recommendations of Parliamentary standing Committee reports.
It is surprising to note that the minimum demands of the employees of a novel scheme (JawaharNavodaya Vidyalayas) of the former prime minister late Sri Rajeev Gandhi, which caters to the needs of education of rural talented students is deserted by the successive Govts.
In the recent letter of Hon’ble Finance Minister addressed to various MPS , two reasons are projected justifying for not granting 1972 CCS Pension viz
1 )A cabinet decision has been taken to implement the new pension scheme to all the employees of NVS including an option for those who have joined prior 1-1-2004.
2) If GPF cum PENSION is granted to employees of NVS, many other would demand for the same.
With regard to the point (1) ,it should be understood by the Hon’ble Minister that the employees of NVS who have joined prior to 1-1-2004 are eligible to enjoy the benefit of 1972 CCS pension as per the policy of the Govt. and consent of the employees was not sought before taking such a decision. It is a fact that while introducing CPF during early years, the then Director did not consult with the employees. Failure to consult the employees by the former Head of the Organization is not a justification to deny their legitimate right.
The second reason pointed out by the Finance Minister is neither logical nor on rational basis as a policy of a Government is to provide GPF cum Pension scheme to those employees who have joined autonomous bodies or Central Government prior to 1-1-2004.

During the last financial year the Hon’ble Prime Minister of India, Dr. Manmohan Singhji had extended 1972 CCS Pension scheme to the employees of Punjab University where he was working as a teacher earlier. The same concern has been extended to five Inter University councils leaving 14000 odd NVS employees in lurch.
Since the Government has been showing a deaf ear to the demands of the employees of Navodaya Vidyalaya Samiti, as per the decision taken by the Joint Action Committee in the meeting held on 31st March 2010 , all the employees of 593 Jawahar Navodaya Vidyalayas across the country and employees of 8 Regional Offices & NVS Headquarters will be on an indefinite strike with effect from 1st August 2010. This decision has been taken as the employees have crossed the threshold of their tolerance level .
Thus in the capacity of Chairman, Navodaya Vidyalaya Samiti and the Minister of concerned Administrative Ministry, it is requested of your good self kindly to take up the issue with the Hon’ble Prime Minister of India and Hon’ble Minister of Finance and evolve a political decision to implement the demands of the employees mentioned in Para 1 for urgent redressal.

However the employees are optimistic that the Government of India will not drag us to an All India strike and settle our issues urgently for which act of kindness employees will be highly obliged to the Government.
Kindly treat this letter as a prior intimation and a formal notice for the proposed indefinite strike to start from 01-09-2010, with a request to redress the demands of the employees.

Dear Sir / Madam,

Please find enclosed a copy of the strike notice given to the Honourable Minister for Human Resource Development, Govt. of India.

The content of the strike notice is self explanatory and the issue introduced in the same notice, relatively, is familiar to all of us who belong and support the Joint Action Committee of employees Associations of Navodaya Vidyalaya Samiti. A little out of this complacent belief, let me be frank that there could be disagreements with regard to the postponement of the indefinite strike which was scheduled from 1st February, 2010.

Before bringing you the purpose of this letter, I would like to appeal to all the supporters of JAC, to shed such disagreements for a while with the conviction that we have given abundant time to the government to act upon and also we have shown our trust in them by yielding to their assurances. Now we have unquestionable right to strike for our genuine demands. Besides, the postponement, partially, was due to the absence of whole hearted support from all regions and employees, which doesn’t need further explanation.

It is time to remind the government that a democratic government cannot have discriminatory attitude towards its citizens and employees. We must tell them in stronger terms that the employees of organizations under same Ministry are being treated in an evidently discriminatory way by not granting GPF cum Pension as per CCS 1972 to the employees of NVS who joined service prior to 01-01-2004.

Now the very purpose of this letter is to invite your esteemed inalienable presence to the Pune Region JAC meeting which is scheduled on 11th July, 2010. We need to show our support to the National JAC which is in the forefront working hard in an indescribable way to achieve our twin demands. We must remember that they are mere employees like each one of us and do not enjoy any special benefits for all the courage they show, for all the risks they venture in and for all the sweat that drench them for the sake of our benefits. Let us not discourage them. Let us strengthen them through this regional meeting, in which we pledge to embark upon the indefinite strike scheduled from 1st August, 2010.

Hence, it is an appeal to all of you to attend the Pune Region JAC Meeting or to send minimum four representatives with full support from each Vidyalaya to the meeting.

After careful perusal of the Draft Guidelines for transfer of employees in Navodaya Vidyalaya Samiti vide letter no.F.3/2009-NVS (Est.II) dated 18th December, 2009 which is issued as an attempt to update the transfer policy of 1999 as a service organization under NVS representing the largest chunk of members All India Navodaya Vidyalaya Staff Association would like to offer the following suggestions for your consideration:

1. The most disturbing aspect of the draft transfer policy is a clause that a waiver may be given in the 7 years tenure at one station for meritorious staff. As such there are no defined norms to assess the excellence among staff and if so they may be properly rewarded by giving away awards, annual special increment as suggested by the 6CPC and not a waiver from transfer. But this will only create disparity among staff and discriminatory attitude on the part of the administration in choosing such staff.

2. There is lack of transparency in the matters of transfer as it does not conform to a seniority list posted in the website for the same for viewing by public and employees to ensure the prospects of transfer.


3. The transfer policy has been framed without the consultation with the representatives of service Associations which is normally anticipated so as to have better liaison with the employees and their democratic participation in decision making as is required in a democratic country. Hence we consider the policy does not possess the basic elements of democracy. NVS is an organization which is registered as a Society Act and is receiving 100% grant in aid from the democratic Government and so is liable to keep obeisance with the basic tenets of democracy.

4. When opportunity is given to those seeking request transfer to another Vidyalaya so as to facilitate unification of spouses, while those who work singly under NVS with their spouse either working in native district or unemployed and destined to be in the native district due to circumstantial difficulties such as looking after senile ailing parents are given a rude shock by not permitting to seek transfer to their native district. Normally such employees are more. No humanitarian consideration is given in this issue. Hence this is painful and unacceptable. Children and spouse of such employees are normally looked down upon by NVS is the saddest part of the transfer policy. It is hence pertinent to seek a transfer to one’s one native district after completing one tenure at one station as posted by NVS.


5. Implementation of transfer on the basis of completion of 7 years in one go would put the system in disarray and bring hardships to many by taking them unawares Hence this may be done in a phased out manner with 10 years initially then reducing to 9 years 8 years and finally 7 years.

6. Moreover it is not mentioned in the draft policy that whether an employee who completes one tenure at one station will be liable for transfer benefits. This is one vital issue that needs to be addressed to .All departments who transfer their staff after a fixed tenure at one station are given transfer benefits.


7. It may be noted that a transfer policy is generally welcome by all staff, but a policy with a hidden agenda, lacking transparency , no uniformity in rules, with full of powers to the administration to override any clause wherever it feels so, unmindful of the genuine rights and necessities of all staff of NVS can never be accepted by all.

We hope that NVS would give due consideration to the above points as they reflect the sentiments of the employees who have enough to be discontented. It is also requested that the NVS may invite the service associations to have discussions so as to implement a transfer policy in right perspective.
