Sub:- Pension Matter

Dear Sir / Madam,

This letter is to appeal to all of you not to forget the Writ Petition NO 518/2012,  in the Hon. Supreme Court, which is coming up for final hearing and argument on 3rd April 2013. This humble reminder is persuaded by the  ongoing baseless  propaganda as if CCS Pension 1972 is  already in our hands through the presentation of Cabinet note as agreed during the strike. I Feel ashamed to hear that celebrations and sweet sharing too are arranged to give a convincing colour to the said propaganda. How can the employees of NVS including the teaching and non teaching staff be carried away by such frivolous imagination !!. Why are they reluctant to exercise  their power of reasoning and lessons from past experience before believing such propaganda which is neatly knitted for achieving certain selfish goals !!!

Now dear fellow friends,  I think all of you are aware of the two Cabinet Notes prepared and submitted  as a part of Samit’s  as well as HRD Ministry’s  ‘Endeavour’  to give us the benefit of CCS Pension. It happened recently once during the tenure of Shri. O. Nabakishore Singh and next during the  tenure of Shri. Manoj Singh, the previous Commissioner. First time, the Finanace Minstry debated the issue and refused the proposal on various grounds. Second time, the cabinet note was not even accepted by the Finance Ministry.

As a part of agreement during the strike, the preparation of another cabinet note is going on. It is  not ideal from our side to take it for granted that pension matter is going to be settled 100% through this activity. Rather it should only be taken as an administrative tactics adopted by the Administrators to persuade the aggrieved employees to withdraw from the strike. Of course  let us   be satisfied  that Samiti is acting. Instead, if we  tend to apply full faith in this processes and ignore the strong and painstakingly filed Writ Petition on the matter in the Supreme Court by almost 26 of our colleagues (WRIT 518/2012), that will be a fatal failure and we shall be suffering from irrecoverable loss by such impudent act.

Hence, dear friends, I implore each one of you to  identify and shun communications circulated for selfish purposes and support the sincere, honest and selfless attempt of this colleagues to get a favourable decision in the matter from the Supreme Court. Since the matter is coming for final hearing on 3rd April.2013, we have very short time left.
Let us realize that Shri. PN Mishra has filed the SLP almost 1 year before and the case is very weak as it does not have sufficient documental support. Moreover, the Ranchi High Court in its Order has minutely observed that he is a deputationist and so he is bound to be governed by the then existing policies of Samiti as he had agreed for the same before getting absorbed.  As far as the writ filed by Shri Reddy is concerned, it is copy of the draft of Writ filed by Shri. S. Kannan, Principal South Goa and others. And he has appointed a very incompetent lawyer as his motive as always is to gain credit through crooked ways. (He is sure Shri. S. Kannan’s Writ will have its fruitful impact on the matter. He hopes to share the credit by filing the same and appointing a weak advocate. Kindly read a letter attached along with the background of his filing the writ.)
Now coming back to the point the WRIT NO 518/2012, it has been filed in November 2012, and admitted in February 2013 and is coming up for final hearing on 3rd April 2013. It speaks  a great volume of the advocates assigned the task to advocate our case in the Supreme Court. Besides, the matter is scheduled on a non miscellaneous day in the court which adds how seriously the bench is going to look into the matter.
What is required right now is a sum of Rs. 10lakh for the Senior as well as junior advocates , as the matter is for final arguments. Hence, I appeal to all AINVSA units to support the matter without any apprehension in minds. Kindly collect minimum Rs. 5000/- from each units and send it to the account given below before 15th of March.
It is  requested  to kindly take steps and do the needful to transfer  the amount to S.B Account Number 605202010002105, in the name of Shri. K. Sanjay, Principal, JNV Tapi & Shri.
